COUNTY OF TARRANT § AUTHORIZING M&C NO. 25782 WHEREAS, the City of Fort Worth ("City") and Hillwood Residential Services, L.P. ("Developer") entered into a Community Facilities Agreement, City Secretary Contract No. 42295 ("Agreement") (inadvertently called an Infrastructure Construction Agreement in the both M&C C- 24971 and C-25782); and WHEREAS, the City desires to have Developer install water and sanitary sewer facilities in the amount of $368,525.00, one hundred percent of this amount is the City's participation obligation; and WHEREAS, the City Council authorized execution of this Amendment No. 1 on the 14th day of August, 2012 via M&C C-25782; and WHEREAS, by this Amendment No. 1, the Water Department is contributing funding in the amount of $283,972.00 and Transportation and Public Works Department, through its previously approved project contingency, is contributing $84,553.00 for the City's share of costs for the water and sewer improvements associated with the North Beach Street from Keller-Hicks Road to Golden Triangle Boulevard contemplated by the Agreement. NOW THEREFORE, City and Developer, acting herein by and through their duly authorized representatives, enter into the following agreement, which amends the Agreement's Original Cost Summary Table shown below to Revised Cost Summary Table 1. The City's participation estimate shall be based upon unit prices contained in City of Fort Worth Ordinance No. 19192 approved on 6/22/2010. The City's cost participation shall be in an amount not to exceed $368,525.00 ("Participation"), but the reimbursement of the Participation (excluding inspection and material testing fees) is not a lump sum amount and may be less than stated above depending upon actual quantities from the Notice of Final Completion package (`Green sheet') and unit prices from the construction contract document and Green sheet but not to exceed the unit prices contained in the City of Fort Worth Ordinance No. 19192; 2. All other provisions of the Agreement, which are not expressly amended herein, shall remain in full force and effect. DISCUSSION: 4 It On June 14, 2011, (M&C C-24971) the City Council authorized the City Manager to execute an Infrastructure Construction Agreement with Hillwood Residential Services, L.P., with City participation in an amount not to exceed $6,400,000.00 utilizing 2008 Capital Improvement Program (CIP) funds and 2007 Certificates of Obligation for this project. This Infrastructure Construction Agreement is for the design and construction of Keller-Hicks Road as a four lane undivided minor arterial street and for the design and construction of North Beach Street from Keller-Hicks Road to Golden Triangle Boulevard as a four lane divided arterial street. This amendment to the Agreement is for the construction of water and sewer improvements along North Beach Street from Keller-Hicks Road to Golden Triangle Boulevard and along Keller-Hicks Road from Alta Vista Boulevard 1,000 feet to the east with funds for water and sewer construction via City participation in the amount of$283,972.00, thereby establishing a total contract cost of $6,683,972.00. TPW s relocation costs in the amount of$84,553.00 will be paid from these contingency funds. Upon City Council approval the City Manager will execute the amended Infrastructure Construction Agreement to allow for the recommended level of City participation. This project is located in COUNCIL DISTRICT 2, Mapsco 22J and 22N.
