FIRST AMENDMENT OF CITY SECRETARY CONTRACT NO. 28274 FOR
ACQUISITION AND RELOCATION SERVICES FROM DFW ADVISORS
WHEREAS, DFW Advisors Ltd. Co. ("Contractor") and the City of Fort Worth
("City") entered into an agreement ("Agreement") for acquisition and relocation services
on December 30, 2002, (City Secretary Contract No. 28274) for the fee simple
acquisition of property and the relocation of the occupants in connection with the noise
mitigation program at Meacham International Airport ("Project").
WHEREAS, the City and the Contractor desire to amend the Agreement to
provide additional compensation in exchange for Contractor performing the services
described in the Amendment, such services shall include the acquisition of additional
properties and therefore additional relocations services.
NOW THEREFORE, City and Contractor agree as follows:
1. Section IV of the Agreement entitling COMPENSATION TO THE CONTRACTOR
is hereby amended as follows:
The Contractor shall be compensated and reimbursed in accordance with the
attached `BUDGET FORECAST -PHASE IV-A (on the Meacham airport
Mitigation Maps) labeled as EXHIBIT "B"- COMPENSATION SCHEDULE.
The City may include additional parcels or delete parcels during the life of this
contract. Exhibit "B " is attached hereto.
Reimbursement in the amount specified herein shall constitute full compensation
for all work performed as well as all supervision, labor, supplies and materials.
Notwithstanding any provision herein to the contrary, Contractor's compensation
shall not exceed $1,402,046.00 without prior written approval of City. The
Billing Statement, in the format attached and incorporated with Exhibit "B" will
be submitted on a monthly basis by the Contractor for approval and payment by
the City. Approved Payments will be processed within 30 days of receipt of the
monthly statement."
2. Exhibit "C" is hereby amended as shown on the attached Revised Exhibit "C".
2. Unless specifically revised herein, all the other terms of the Agreement shall remain
unchanged and continue in full force and effect.

Authorize Execution of Amendment No. 1 to City Secretary Contract No. 28274 with DFW Advisors,
Ltd. Company for Project Management of the Noise Mitigation Program at Fort Worth Meacham
International Airport
RECOMMENDATION:
It is recommended that the City Council authorize the City Manager to execute Amendment No. 1 to City
Secretary Contract No. 28274 with DFW Advisors, Ltd. Company, thereby increasing the original contract
amount of$925,621 by $476,425 for a revised total contract amount of$1,402,046.
DISCUSSION:
The City Council approved the selection and award of a contract to DFW Advisors, Ltd. Company for the
management of the Noise Mitigation Program (Phase IV) at Fort Worth Meacham International Airport on
December 17, 2002 (M&C C-19393).
The contract specifies the contractor will acquire 85 parcels in connection with the Federal Aviation
Regulations (FAR) Part 150 Noise Study for Fort Worth Meacham International Airport. Grant funds of
$4,000,000 for Land — Noise Compatibility, plus $444,444 in City matching, were made available under a
grant accepted by the City Council on September 10, 2002 (M&C G-13729).
The City Council approved the acceptance of an additional grant from the Federal Aviation Administration
(FAA) in the amount of $665,000, on August 24, 2004 (M&C G-14473), for assistance in completing the
acquisition of parcels in Phase IV-A. The City's match is $35,00.0 for a total grant fund amount of$700,000.
The proposed amendment to increase the contract with DFW Advisors, Ltd. Company by $476,425 will
provide for the acquisition of an additional 16 vacant lots currently owned by the local taxing jurisdictions
through tax foreclosures. This amendment will also increase available funding for the continued acquisition
of parcels and for relocation costs of owners and tenants, which has been more costly than previously
anticipated. A revised budget increasing the funding available has been reviewed and accepted by the FAA
and City staff.
DFW Advisors Ltd. Company is in compliance with the City's M/WBE Ordinance by committing to 15%
M/WBE participation on this increase. The City's goal on this project is 15%.
The properties are located in COUNCIL DISTRICT 2, Mapsco 48W.
