TO CITY SECRETARY CONTRACT No. 45098
WHEREAS, the City of Fort Worth (CITY) and Kimley-Horn and
Associates, Inc . , (ENGINEER) made and entered into City Secretary
Contract No. 45098, (the CONTRACT) which was authorized by M&C C-26524 on
the 3rd day of October, 2014 in the amount of $ 500, 000 . 00; and
WHEREAS, the CONTRACT involves engineering services for the
following project:
ON-CALL ROUNDABOUT DESIGN SERVICES; and
WHEREAS, it has become necessary to execute Amendment No. 1 to the
CONTRACT to include an increased scope of work and revised fee .
NOW THEREFORE, CITY and ENGINEER, acting herein by and through their
duly authorized representatives, enter into the following agreement,
which amends the CONTRACT:

Article I of the CONTRACT is amended to include the additional
engineering services for on-call design of roundabouts, intersections
and connected roadways as agreed upon in task orders to be defined at a
later date within the remainder of the initial 24-month time period
specified in the initial contract in the amount of $500, 000 . 00 .
2 .
Article II of the CONTRACT is amended to provide for an increase in
the fee to be paid to Engineer for all work and services performed under
the Contract, as amended, so that the total fee paid by the City for all
work and services shall be an amount of $1, 000, 000 . 00 .
3 .
All other provisions of the Contract, which are not expressly
amended herein, shall remain in full force and effect .

below.

HEARING:
SUBJECT: Authorize Execution of Amendment No. 1 to City Secretary Contract No. 45098, an
Engineering Services Agreement with Kimley-Horn and Associates, Inc., in the Amount of
$500,000.00 for On-Call Roundabout and Intersection Design Services, Thereby
Increasing the Total Contract Amount to $1,000,000.00 (ALL COUNCIL DISTRICTS)
RECOMMENDATION:
It is recommended that the City Council authorize execution of Amendment No. 1 to City Secretary
Contract No. 45098, an Engineering Services Agreement with Kimley-Horn and Associates, Inc., in
the amount of$500,000.00 for on-call roundabout and intersection design services, thereby
increasing the total contract amount to $1,000,000.00.
DISCUSSION:
This Agreement provides for design services associated with roundabout projects. Specific services
are defined for each project element through a task order work authorization. Kimley-Horn and
Associates, Inc., has completed design of one roundabout and is finishing design on four other
locations.
Amendment No.1 will increase the contract limit from the initial $500,000.00 to a total of
$1,000,000.00 enabling completion of the existing task orders and assignment of additional locations
over the remaining duration of the contract.

resources within the General Fund will be used to provide interim financing until debt is issued. Once

debt associated with this project is sold, bond proceeds will reimburse the General Fund in
accordance with the statement expressing official intent to reimburse that was adopted as part of the
ordinance canvassing the bond election Ordinance 21241-05-2014,
M/WBE Office - Kimley-Horn and Associates, Inc., agree to maintain its initial M/WBE commitment of
10 percent that it made on the original Agreement and extend and maintain that same M/WBE
commitment of 10 percent to this first amendment. Therefore, Kimley-Horn and Associates, Inc.,
remains in compliance with the City's MNVBE Ordinance and attests to its commitment by its
signature on the Acceptance of Previous MNVBE Commitment form executed by an authorized
representative of its company.
FISCAL INFORMATION/CERTIFICATION:
The Financial Management Services Director certifies that funds are available in the General Fund to
pay expenses which will be incurred on this contract until reimbursement can occur from the issuance
of public securities. Funds will be available in the various capital projects, as appropriated, on a
project by project basis.
