HomeMy WebLinkAboutContract 45800-A1 MYSKMARY AMENDMENT No.l TO CITY SECRETARY CONTRACT No. 45800 WHEREAS, the City of Fort Worth (CITY) and Freese and Nichols, Inc. , (ENGINEER) made and entered into City Secretary Contract No. 45800 , (the CONTRACT) which was authorized administratively on the 30th day of July, 2014 in the amount of $ 8, 951. 00; and WHEREAS, the CONTRACT involves engineering services for the following project: Fort Worth Nature Center and Refuge Levee Improvements Project; and WHEREAS, it has become necessary to execute Amendment No. 1 to the CONTRACT to include an increased scope of work and revised fee . NOW THEREFORE, CITY and ENGINEER, acting herein by and through their duly authorized representatives, enter into the following agreement, which amends the CONTRACT: 1. Article I of the CONTRACT is amended to include the additional engineering services specified in a proposal dated October 8, 2014, a copy of which is attached hereto and incorporated herein. The cost to City for the additional design services to be performed by Engineer totals $12, 060. 00. (See Attached Funding Breakdown Sheet, Page -3-) 2 . Article II of the CONTRACT is amended to provide for an increase in the fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall be an amount of $21, 011 . 00. 3 . All other provisions of the Contract, which are not expressly amended herein, shall remain in full force and effect. EXECUTED and EFFECTIVE as of the date last written by a signatory, below. Project Manager Associate ATTACHMENT "A" Scope of Services for Fort Worth Nature Center and Refuge (FWNC&R) Levee Improvements The scope set forth herein defines the work to be performed by the ENGINEER in completing the project. Both the CITY and ENGINEER have attempted to clearly define the work to be performed and address the needs of the Project. Under this scope, "ENGINEER" is expanded to include any sub-consultant, including surveyor, employed or contracted by the ENGINEER. OBJECTIVE Within the FWNC&R property, there is an earthen embankment that is referred to as the levee. ENGINEER has conducted an alternatives analysis to evaluate potential improvements to the levee. Upon review of the identified alternatives, the CITY and ENGINEER agreed that geotechnical investigations are warranted before proceeding with final design activities. This scope of work includes geotechnical investigations and one meeting with the client to review the results of the work. GEOTECHNICAL INVESTIGATION. • Travel to the site to select locations for exploratory borings. Engineer will stake the specific locations after checking underground utilities, other existing construction, and accessibility. Accessibility along the embankment will be obtained from the Nature Center road on the southern end of the embankment. • Subcontract with a drilling contractor to drill one (1) boring to a depth of 25 feet at the preferred location of the pedestrian bridge structure. Three (3) additional exploratory borings to a depth of 20 feet will be drilled to help evaluate the condition of the earthen embankment. Soil samples will be collected intermittently using continuous flight augers and either split-spoon or tube samplers. Rock and rock-like materials will be tested in situ using a TxDOT Cone Penetration Test, as appropriate for the material. At completion, the boreholes will be grouted with bentonite slurry to the ground surface to prevent erosion and deterioration of the embankment. • Provide an engineer or geologist to direct the drilling, log the borings, record field test data, and handle and transport the samples. • Select samples for laboratory testing, assign tests, deliver samples to a subcontractor laboratory selected by FNI, and review test results. Testing is expected to include classification tests (liquid and plastic limits and percent passing a #200 sieve or gradation), moisture content, and unconfined compression strength tests. • Prepare a technical memorandum summary report of the geotechnical investigation to include: City,of Fort worth,Texas Attachment A PMO Release Date:07/23/2012 Page 11 of-2126 1✓ • Appendix with the boring locations, boring logs, laboratory test results, and a key to the symbols used. • Discussion of subsurface conditions and soil properties indicated by the field and laboratory work, and the implications for design and construction. • Foundation and site preparation recommendations for the proposed weir structure. • Provide general comments, based upon the soil types and condition of the materials encountered by the borings, on the condition of the embankment as it relates to resiliency during flood or overflow events. • Earthwork related recommendations for use during development of the plans and specifications. • Meet with CITY to review results of geotechnical investigation and update estimated cost for proposed alternatives. ASSUMPTIONS • A total of four(4)soil borings are proposed. DELIVERABLES A. Technical memorandum B. Meeting summary ADDITIONAL SERVICES NOT INCLUDED IN THE EXISTING SCOPE OF SERVICES Additional Services not included in the existing Scope of Services — CITY and ENGINEER agree that.the following services are beyond the Scope of Services described in the tasks above. However, ENGINEER can provide these services, if needed, upon the CITY's written request. Any additional amounts paid to the ENGINEER as a result of any material change to the Scope of the Project shall be agreed upon in writing by both parties before the services are performed. These additional services include the following: • Negotiation of easements or property acquisition. • Services related to development of the CITY's project financing and/or budget. • Services related to disputes over pre-qualification, bid protests, bid rejection and re-bidding of the contract for construction. • Construction management and inspection services • Performance of materials testing or specialty testing services. • Services necessary due to the default of the Contractor. • Services related to damages caused by fire, flood, earthquake or other acts of God. • Services related to warranty claims, enforcement and inspection after final completion. • Services to support, prepare, document, bring, defend, or assist in litigation undertaken or defended by the CITY. City of Fort Worth,Texas Attachment A PMO Release Date:07/23/2012 Page 2 of 3 • Performance of miscellaneous and supplemental services related to the project as requested by the CITY. • Detailed hydraulic modeling • Preparation of LOMR, CLOMR or other FEMA submittals • Requests for additional information from the USACE in regard to the PCN or PJD map. • Consultation with the Texas Historical Commission. • Preparation of a jurisdictional determination report. • Preparation of a standard individual Section 404 permit application. • Preparation of an Environmental Information Document, Environmental Assessment, or an Environmental Impact Statement. • Cultural resource studies or investigations. • Meetings or consultation with the USACE or other resource agencies. • Consultation with the U. S. Fish and Wildlife Service under Section 7 of the Endangered Species act. • Presence/absence surveys for federally listed threatened/endangered species. • Preparation of a mitigation plan to compensate for impacts to waters of the U.S. • Application to Texas Commission on Environmental Quality for individual 401 Water Quality Certification. • Application for General Land Office easements. • Application for Texas Parks &Wildlife Department Sand and Gravel. Permit. • Additional field investigations or analysis required to respond to public or resource agency comments. • Expert representation at legal proceedings or at contested hearings. • Mitigation monitoring if required by permit conditions. • Monitoring for compliance with permit conditions. • Phase I or Phase II Environmental Site Assessment.
