QL;JrL- (M&C Needed) COUNTY OF TARRANT S WHEREAS, the City of Fort Worth (City) and Camp Dresser & McKee, Inc. , (Engineer) made and entered into City Secretary Contract No. 27761 , (the Contract) which was authorized by the City Council by M&C C-19103 on the 28th day of May, 2002 and subsequently revised by two previous amendments; and WHEREAS, the Contract involves engineering services for the following project: Engineering design of Northside II 48-inch Water Main Extension Contract 2, Sections A and B. WHEREAS, it has become necessary to execute Amendment No. 3 to said Contract to include an increased scope of work and revised maximum fee; NOW THEREFORE, City and Engineer, acting herein by and through their duly authorized representatives, enter into the following agreement which amends the Contract: 1 . Article I, of the Contract is amended to include the addition- al engineering services specified in M&C C-20823, adopted by the City Council on 28th day of June, 2005, and further amplified in a proposal letter dated May 16, 2005, copies of which are both attached hereto and incorporated herein. The cost to City for the additional services to be performed by Engineer total $487,123.00 . 2 . Article II, of the Contract is amended to provide for an increase in the maximum fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall not exceed the sum of $1,810,080 .52. City of Fort Worth Department of Engineering 1000 Throckmorton Street Fort Worth,Texas 76102-6311 Subject: Northside II -48-inch Water Main Engineering Services Fee-Amendment No. 3 Dear Mike: CDM is under contract to provide engineering design services for the Northside II-48-inch Water Main,Sections A and B project. Section A is completed and operational. We have been working the past many months to finalize the alignment of Section B. As you are aware, the City of Fort Worth is experiencing tremendous growth, specifically in the area north of Loop 820,including new residential and retail developments and natural gas wells and gathering lines. When this project started,much of the property that could be impacted by the new waterline was undeveloped agricultural land. For the most part, the alignments were adjacent to property lines,in order to not restrict future land use. The area became more and more desirable for development and the sale of land grew. Then we were met with the rapid influx of natural gas wells and pipelines. This resulted in relocation of much of the initial waterline alignment. Properties were being sold and the developers started their conceptual planning stages. The realignment of the waterline was on hold until the developer's engineers and planners had conceptual development layouts. As you know,because of these circumstances,it has taken over nine months to determine a final alignment for the overall route. Most of the waterline alignments were moved from being adjacent to the property line to street and road right-of-ways, park areas or adjacent to floodplain,for ease of maintenance and repair in the future. The new alignments are located in substantially different locations from the previous alignments. May 16,2005 Page 2 the need for new field topographic survey, research for existing utilities, cathodic protection design, new plan and profile sheets, and new cost estimates for construction. The area of realignment is shown on the attached drawing. CDM proposes to complete the work in accordance with the attached schedule. The proposed amendment to CDM's engineering contract for revising the alignment and coordination of the changes with the developers, Developer's consultants and City departments is detailed on the attached spreadsheets. The total amendment is $487,123. which results in a new not-to-exceed limit for the contract of$1,810,080.52. Shown below is a summary of previous amendments. DISCUSSION: On May 28, 2002, (M&C C-19103) the City Council authorized the City Manager to execute an agreement with Camp Dresser & McKee, Inc., in the amount of $1,265,331.00 for the Northside II 48-inch Water Main Extension Contract 2, Sections A and B. The agreement was subsequently revised by two previous amendments totaling $57,626.52 as follows: . Amendment No. 1 in the amount of $44,586.52 (M&C C-19773 on September 30, 2003) primarily provided for the design of 3,100 feet of 48-inch water main that was added to extend the water line to Heritage Trace Parkway. . Amendment No. 2 in the amount of $13,040.00 primarily provided for revisions to the project plans to accommodate actual field conditions that were encountered during construction of Section A. In order to expedite design and construction, the project was divided into two sections, Section A and Section B. Section A has been constructed. Section B is under design and will extend the water main from the Cantrell Sansom Pump Station to Park Glen Boulevard. At the time the original engineering agreement was executed, the majority of the land that Section B would have impacted was undeveloped agricultural land and consequently the initial alignment was selected and designed adjacent to the property lines of such undeveloped properties. Amendment No. 3 will address the following: Due to recent new and proposed development within the project area, it is necessary to select and design a completely new alignment for Section B. In addition, several gas wells and pipelines have been constructed that are in conflict with the current alignment. "rhe proposed amendment will allow the water main to be relocated (from adjacent to property lines and gas wells/pipelines) into future public street/right-of-way and future park areas, so that the line can be readily accessed for maintenance and repair after the surrounding area is fully developed. City staff considers this amount to be fair and reasonable. in addition to the amendment amount, $92,250 is required for project management and real property services by the Engineering Department. Camp Dresser & McKee, Inc., is in compliance with the City's M/WBE Ordinance by committing to 32% M/WBE participation. The City's goal on this amendment is 15%. This project is located in COUNCIL DITRICTS 2 and 7.
