WHEREAS, the City of Fort Worth (City) and Lockwood, Andrews &
Newnam, Inc. , (Engineer) made and entered, into City Secretary
Contract No. 28790, (the Contract) which was authorized by the City
Council by M&C C-19585; on the 13th day of May 2003; and
subsequently revised by two previous amendments; and
WHEREAS, the Contract involves engineering services for the
following project:
Sanitary Sewer Rehabilitation Contract LXVII (67)
WHEREAS, it has become necessary to execute Amendment No. 3 to
said Contract to include an increased scope of work and revised
maximum fee;
NOW THEREFORE , City and Engineer, acting herein by and through
their duly authorized representatives, enter into the following
agreement which amends the Contract:

Article I of the Contract is amended to include the additional
engineering services specified in a proposal letter dated August
13, 2004 , a copy of which is attached hereto and incorporated
herein. The cost to City for the additional design services to be
performed by Engineer total $14 ,900.00.

Article II of the Contract is amended to provide for an
increase in the maximum fee to be paid to Engineer for all work and
services performed under the Contract, as amended, so that the
total fee paid by the City for all work and services shall not
exceed the sum of $318,368.00.

All other provisions of the Contract which are not expressly amended
herein shall remain in full force and effect.

Alignment Study for White Settlement Sewer Main

Dear Mr. Conlon:
Following our meeting with you and Mr. Peter Fu, P.E. on July 29, 2004, we have developed this
Amendment No. 3 with respect to the above referenced project. The amendment corresponds to the
performance of an alternative alignment study for the proposed Write Settlement Road sewer main that is
being design to serve the north portion of the Montgomery Ward property and areas to the west including
the Linwood Addition. An alternative alignment for the sewer main is needed in order to avoid conflict
with the Trinity River Vision project.
Performance of the alternative alignment study will entail the preparation of a Preliminary Engineering
Report (PER), similar to that originally produced during the initial phases of this project. The PER will
I nclude a written narrative describing the alternative alignments under consideration with a
recommendation for selection. An alignment exhibit will be prepared and photographs of existing
conditions along the routes under consideration will be provided. Opinions of probable construction costs
associated with each alternative will also be given. Exhibit D, enclosed, depicts the alignment alternatives
that will initially be considered. It is noted that other alignments may also be considered during the
course of the study in order to determine the best route selection.
Based upon the work to be performed as described above, a lump sum fee addition of$14,900 is hereby
requested. This increase will adjust the contract fee from$303,466 to $318,366.
