TEXAS DEPARTMENT OF TRANSPORTATION AIRPORT PROJECT PARTICIPATION AGREEMENT (Federally Assisted Airport Development) TxDOT Project No.:AP FW SPINKS 6 TxDOT CSJ No.: 0402SPINK TxDOT Contract No. : 4XXAV085 Amendment No. 01 to the Agreement Part I-Identification of the Project TO: The City of Fort Worth,Texas FROM: The State of Texas, acting through the Texas Department of Transportation The City of Fort Worth, Texas, hereinafter referred to as the "Sponsor," and the Texas Department of Transportation, hereinafter referred to as the "State," have entered into an Airport Project Participation Agreement TxDOT CSJ Number 0402SPINK, executed by the Sponsor on March 30, 2004, and by the State on April 6, 2004, for the development of the Fort Worth Spinks Airport,hereinafter referred to as the"Airport". The project is described as follows: construction services to expand apron and install medium intensity taxiway lights for Taxiway "B" at the Fort Worth Spinks Airport as approved by the Texas Transportation Commission on February 26,2004. It is in the mutual interest of the Sponsor and the State to increase the agreement by $130,000 based on bids received. Part II - Offer of Financial Assistance, estimates total project costs to be $870,000; and financial assistance is currently limited to$783,000 in federal funds and$87,000 in local sponsor funds. The following amendment to the Airport Project Participation Agreement shall become effective upon execution of this Amendment by the Sponsor and the State. The Airport Project Participation Agreement is amended as follows: I. On Part II, Item No. 2 of the Agreement, change Amount A, estimated total construction costs, and any further references in the Agreement to Amount A, to$1,000,000. 2. On Part Il, Item No. 2 of the Agreement, change Amount B, estimated construction costs Page 1 of 3 03--25-05A11 52 KCVO FY. ' OUR, fix. On Part II, Item 3 of the Agreement, change Amount C, the maximum obligation of the United States payable under this offer, and any further references in the Agreement to Amount C,to$900,000. 4. On Part II, Item 4 of the Agreement, change Amount D, Sponsor's share of the estimated construction costs, and any further references in the Agreement to Amount D, to$100,000. All other terms and conditions of the agreement are unchanged and remain in full force and effect. This Amendment to the Airport Project Participation Agreement between the City of Fort Worth,Texas, and the Texas Department of Transportation is mutually agreed to and accepted. Execute Amendment No. 1 to the Texas Department of Transportation (TxDOT) planned airfield upgrade project at Fort Worth Spinks Airport, increasing the overall grant amount from $870,000 to $1,000,000, of which $117,000 will be funded by TxDOT and $13,000 will be funded by the City; and 2. Authorize the transfer of$13,000 from the Aviation Capital Projects Fund to the Airport Grants Fund for the City's match; and 3. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Airport Grants Fund by $130,000. DISCUSSION: On March 23, 2004 (M&C G-14307), the City Council authorized the City Manager to apply for and accept a grant from the Texas Department of Transportation (TxDOT) in the amount of$870,000 to fund the planned airfield upgrade project at Fort Worth Spinks Airport. As a result of increases in estimated costs, TxDOT has offered an amendment to the grant, increasing the eligible amount to $1,000,000 in accordance with the program guidelines. On February 29, 2000 (M&C G-12836), the City Council authorized the sale of Certificate of Obligation Series 2000A, which included grant-matching funds for general improvements at Spinks Airport in the amount of$1,000,000. Of these COs, there is an available balance that can be used to support this project. This property is located in COUNCIL DISTRICT 8. FISCAL INFORMATION/CERTIFICATION: The Finance Director certifies that upon receipt of an executed grant amendment, approval and completion of the above recommendations and adoption of the attached appropriation ordinance, funds will be available in the current capital budget, as appropriated, of the Airport Grants Fund.
