WHEREAS, the City of Fort Worth (City) and Lockwood, Andrews &
Newnam, Inc. , (Engineer) made and entered into City Secretary
Contract No. 28790, (the Contract) which was authorized by the City
Council by M&C C-19585; on the 13th day of May 2003; and
subsequently revised by one previous amendment; and
WHEREAS, the Contract involves engineering services for the
following project:
Sanitary Sewer Rehabilitation Contract LXVII (67)
WHEREAS, it has become necessary to execute Amendment No. 2 to
said Contract to include an increased scope of work and revised
maximum fee;
NOW THEREFORE, City and Engineer, acting herein by and through
their duly authorized representatives, enter into the following
agreement which amends the Contract:
1.
Article I of the Contract is amended to include the additional
engineering services specified in a proposal letter dated July 30,
2004, a copy of which is attached hereto and incorporated herein.
The cost to City for the additional design services to be performed
by Engineer total $20,410.00.
2.
Article II of the Contract is amended to provide for an
increase in the maximum fee to be paid to Engineer for all work and
services performed under the Contract, as amended, so that the
total fee paid by the City for all work and services shall not
exceed the sum of $303,466.00.
3.
All other provisions of the Contract which are not expressly amended
herein shall remain in full force and effect.

Engineering and Survey Services for M-132 Abandonment

Dear Mr. Conlon:
Following a number of meetings with you and City of Fort Worth staff, we have developed this
Amendment No. 2 with respect to the above referenced project. The amendment corresponds to the
additional survey and engineering services that Lockwood, Andrews & Newnam, Inc. (LAN) has
performed in order to increase the project limits beyond the original scope with respect to the existing M-
132 sewer main in the proximity of White Settlement Road and Henderson Street.
During design development, it was recognized that the provision of the new sewer main in White
Settlement Road can allow for the complete abandonment of the remaining portion of sewer main M-132
between stations 27+02 and 44+28 (see Exhibit Q. Research of existing records and follow-up with City
staff determined that this portion of the sewer main is characterized by buildings located over the main,
difficult access, poor grades, and has experienced chronic maintenance problems. It was recognized that
abandonment of this main through the provision of lateral connections to the new White Settlement main
would improve existing conditions. Survey and utility research data for this abandonment and design of
lateral connections was not included with the original project scope. At your direction, LAN proceeded
with the additional survey, research and design in order to facilitate the abandonment of the M-132 main
and reconnection of its service area. Construction documents were subsequently prepared and delivered
to the City earlier this year.
Based upon the work performed in order to meet the increased scope requirements as described above, a
lump sum fee addition of$20,410 is hereby requested. This increase will adjust the engineering fee from
$283,056 to $303,466.
