(Engineer) made and entered into City Secretary Contract No. 42955 (Contract) which was authorized by the City Council by M&C C-25449 on the 21St day of February, 2012; and WHEREAS, Amendment No. 1, in the amount of $39,000.00, was administratively authorized on July 20, 2012 and Amendment No. 2, in the amount of $331,662.00 was authorized by M&C C-26741 on September 24,2013; and WHEREAS, it is necessary to execute Amendment No. 3 to said Contract to include an increased scope of work and revised maximum fee; and WHEREAS,the Contract involves engineering services for the following project: Casino Beach and Watercress Drive—Water and Sanitary Sewer Improvements; NOW THEREFORE, City and Engineer, acting herein by and through their duly authorized representatives, enter into the following agreement, which amends the Contract: 1. Article I of the Contract is amended to include the additional engineering services described in a proposal letter dated September 12, 2014, for Phase 3-Love Circle Water and Low Pressure Sewer Improvements, a copy of which is attached hereto and incorporated herein. The original Contract, Contract Amendment 1, and Contract Amendment 2 provided for the Design, Bid and Construction Phase services for the Casino Beach lift station and force main, a water line from Silver Creek Road to the new development at Casino Beach Park, and a water main to provide a loop, as backup, to the north part of Lake Worth. Phase III Love Circle Low Pressure Sanitary Sewer Line and Water Line, will provide water and low pressure sewer service to residences along Love Circle as shown in Exhibit 1. Future phases will include; gravity and low pressure sanitary sewer force mains along Watercress Drive, and water and low pressure sanitary service to residents along Peninsula Club Circle, North Lake Drive, Island View Drive, and improvements to Meadow Lakes lift station and abandonment of Jenkin Heights lift station. BASIC ENGINEERING SERVICES SUMMARY DESIGN PHASE (PHASE 111)—LOVE CIRCLE Design of up to 5,100 LF of small diameter low pressure sanitary sewer system with up to a total of 54 grinder pump individual services and up to 6,800 LF of 8-inch water line per the attached Exhibit 1. The pipelines, both water and sewer, will be designed in plan view only, with no profile drafted. The low pressure sewer portion will use standards from previous low pressure project at Lake Worth. The pipeline will be in City ROW- Love Circle (or in adjacent property in existing utility easements) and TXDOT ROW-Jacksboro Highway. Service taps will be provided to residences along Love Circle from the low pressure sanitary sewer line and 8-inch water line. The engineer will estimate, using aerial photos, residential low pressure force main connection locations to the main. This estimated location will be mailed to residents for confirmation and will be again confirmed by the contractor with the City's inspectors prior to the work being performed. The sanitary sewer pipe material will be 1-1/4-inch to 4-inch DR 11 HDPE, butt fused and will be constructed by open trench. The 8-inch water line pipe material will be PVC using ductile iron fittings and will be constructed by open trench with the exception of two conventional dry auger bores under Jacksboro Highway. E-1 grinder pumps price will be pre-established through negotiation and letter of commitment. The E-1 pricing letter of commitment will be provided in contract documents for the general contractor to identify pricing. The Engineer will run a hydraulic model to establish size of low pressure force main corresponding with number of houses online. Engineer will use pre-established details for valving and isolation, service connection assembly, flushing, cleanout, and grinder pumps. The engineer will use City of Fort Worth Standard details where applicable. The design will be for a single construction project. Up to Two(2) Easement Documents and up to 6,400 LF of topographic survey. 2. Geotechnical investigation and reporting will be prepared based on four(4)soil borings. 3. Preparation of TXDOT permitting documents for two (2) crossings of Jacksboro Highway (Highway 199)and incorporation into the bid documents. B. Bid Phase Assistance for Phase 3. Provide Bid Phase Assistance for one construction contract similar to the original contract scope. C. Construction Administration Assistance for Phase 3. This phase will be similar to the original contract scope for one construction contract with the following changes: The Engineer will visit the site up to six (6) times for construction progress meetings or specific issue meetings. The Engineer will respond to up to twelve (12) Request for Information from the contractor and will review up to twenty (20) submittals and shop drawings, prepare up to eight (8) PCMs / CMRs, and three(3) Field Orders or Change Orders. ADDITIONAL SERVICES Additional Services not included in the existing Scope of Services of Phase I or Phase II — CITY and ENGINEER agree that the following services are beyond the Scope of Services described in the tasks above. However, ENGINEER can provide these services, if needed, upon the CITY's written request. Any additional amounts paid to the ENGINEER as a result of any material change to the Scope of the Project shall be agreed upon in writing by both parties before the services are performed. These additional services include the following: 1. Negotiation of easements or property acquisition including temporary right-of-entries. 2. Services related to development of the CITY's project financing and/or budget. 3. Services related to disputes over pre-qualification, bid protests, bid rejection and re-bidding of the contract for construction. 4. Construction management and inspection services other than previously identified. 5. Performance of materials testing or specialty testing services. 6. Services necessary due to the default of the Contractor. 7. Services related to damages caused by fire, flood, earthquake or other acts of God. 8. Services related to warranty claims, enforcement and inspection after final completion. 9. Services related to Survey Construction Staking 10. Services related to acquiring real property including but not limited to easements, right-of- way, and/or temporary right-of-entries. 11. Services to support, prepare, document, bring, defend, or assist in litigation undertaken or defended by the CITY. 12. Performance of miscellaneous and supplemental services related to the project as requested by the CITY. 13. Services related to preparation of Storm Water Pollution Prevention Plans. 14. Services related to preparation of Traffic Control Plan. 15. Dedicated Grinder Pump Equipment Supply and Service Agreement Bid. 16. Services related to location or elevation of grinder pumps, or coordination with residents for disconnect, inspection of plumbing or electrical services, including easements. Compensation A. The ENGINEER shall be compensated $261,908.00 as summarized in Exhibit B1 — Engineer Invoice. The fee shall be considered full compensation for the services described Attachment A, including all labor materials, supplies, and equipment necessary to deliver the services. Services shall be paid on a total lump sum basis of$261,908.00. B. The ENGINEER shall be paid monthly payments as described in Section II—Method of Payment. II. Method of Payment A. Partial payment shall be made to the ENGINEER monthly upon City's approval of an invoice prepared and submitted by the ENGINEER. B. The estimated current physical percent complete as required on the invoice shall be calculated from the progress schedule. C. The cumulative sum of such monthly partial fee payments shall not exceed the total current project budget including all approved Amendments. D. Each invoice shall be verified as to its accuracy and compliance with the terms of this Agreement by an officer of the ENGINEER. III. Progress Reports A. The ENGINEER shall prepare and submit to the designated representative of the Water Department monthly progress reports in the format required by the City. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Lake Worth Gas Lease Capital Improvement Fund in the amount of$261,908.00 from Gas Well Revenues; and 2. Authorize the transfer of$261,908.00 from the Lake Worth Gas Lease Capital Improvement Fund to the Water Capital Projects Fund and the Sewer Capital Projects Fund; and 3. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Water Capital Projects Fund in the amount of$117,858.60 and Sewer Capital Projects Fund in the amount of$144,049.40; and 4. Authorize the City Manager to execute Amendment No. 3 with Alan Plummer Associates, Inc., for engineering and design services associated with the Casino Beach/Watercress Water and Sewer Improvements Phase 2 at Lake Worth. DISCUSSION: On January 8, 2008, the City Council amended the Gas Well Revenue Distribution Policy to allow for revenues derived from lease bonuses and royalties from properties in and around Lake Worth to be used for the execution of the 2007 Lake Worth Capital Improvements Implementation Plan. On July 22, 2011 Alan Plummer Associates, Inc., responded to a request for proposals and was selected to design a water and sewer system for the Watercress, Casino Beach and Love Circle areas. Due to budget limitations it was decided to award portions of the design and engineering as funding became available. On February 21, 2012, the City Council awarded the first engineering and design contract (M&C C-25449) to Alan Plummer Associates, Inc., in the amount of$696,954.40 for the Casino Beach/Watercress Water and Sewer Improvements Phase 1. Amendment No. 1 in the amount of $39,000.00 was necessary to cover additional easements, surveying and the design of a larger lift station. Amendment No. 2 (M&C C-26471) in the amount of$331,662.00 provided for engineering services and design of a water main to cross Lake Worth and complete the loop of the water system in the Casino Beach/Watercress area. This proposed Amendment No. 3 will provide for the design of a water and sewer system to serve 54 residential customers on Love Circle. This area is currently not served by municipal water and sewer systems and relies on private wells and septic systems.
