COUNTY OF TARRANT $
WHEREAS, the City of Fort Worth (City) and TranSystems
Corporation Consultants, (Engineer) made and entered into City
Secretary Contract No. 29020, (the Contract) which was authorized
by the City Council by M&C C-19703 on the 12th day of August 2003;
and
WHEREAS, the Contract involves engineering services for the
following project:
Walsh Ranch Sewer Main Extension, Phases 1A, 1B and
1D.
WHEREAS, it has become necessary to execute Amendment No. 1 to
said Contract to include an increased scope of work and revised
maximum fee;
NOW THEREFORE, City and Engineer, acting herein by and through
their duly authorized representatives, enter into the following
agreement which amends the Contract:
1 .
Article I of the Contract is amended to include the additional
engineering services specified in a proposal letter dated July 27,
2004, a copy of which is attached hereto and incorporated herein.
The cost to City for the additional design services to be performed
by Engineer total $11,910.00.
2 .
Article II of the Contract is amended to provide for an
increase in the maximum fee to be paid to Engineer for all work and
services performed under the Contract, as amended, so that the
total fee paid by the City for all work and services shall not
exceed the sum of $596,970.00.

All other provisions of the Contract which are not expressly amended
herein shall remain in full force and effect.

Request for Supplemental Compensation to Contract
Dear Mr. Conlon:
I am writing this letter to request additional compensation relating to services performed
to obtain Right of Entry and cooperation with the Lee Bass Trust, tract of land, as
described below.
1. Legal Fees — TranSystems entered into discussions with representatives of Lee
Bass to gain approval to access property to conduct surveys, archeological
studies, wetland studies and geotechnical investigation. After meetings, extended
conversations and written descriptions of work, Bass presented a Right-of-Entry
agreement that was filled with indemnifications and hold harmless clauses that
required independent legal council review and editing. These back and forth
discussions and contract modifications resulted in an additional $2,000 in legal
fees and costs to TranSystems to simply obtain access to the property.
2. Video tapping of Survey Operations — During discussions that included the City
Attorney's office, it was agreed to with Lee Bass that video tapping of survey
work would be performed to document that all conditions of right-of-entry were
being complied with.
60 hours @ $85/hr=$5,100.00
3. Sewer Reroutes — 2 reroutes (original route based on Bass representative
directives) were requested by the Bass Properties after final walk through of
centerline staking. The original route was based on directive by Bass to avoid
trees; reroutes were directed by Bass to actually run through the very trees that
originally we were directed to avoid. Reroutes were then resurveyed. These
reroutes were accommodated to provide good will with property owner.

We are requesting that our contract be increased by $11,910.00 for compensation to
