HomeMy WebLinkAboutContract 30451 County: Tarrant CITY SECRETAM CSJ: 0902-48-410 CONTRACT NO3—CILC2 Project No: STP 2000 (646)TE Location: Berry Street : Henderson Street East to Evans Street ADVANCE FUNDING AGREEMENT AMENDMENT #2 THIS AMENDMENT IS MADE BY AND BETWEEN the State of Texas, acting through the Texas Department of Transportation, hereinafter called the State, and the City of Fort Worth, acting by and through it's duly authorized officials, hereinafter called the 'Local Government." WITNESSETH WHEREAS, the State and the Local Government executed a contract on 25th of October 2000 to effectuate their agreement to construct enhancements along Berry Street from 6 Street East to Evans Street; and, WHEREAS, The State and the Local Government executed Amendment #1 on 31St of July 2001 to authorize the Local Government to locally let the project; and, WHEREAS, it has become necessary to amend that contract; WHEREAS, The limits of the project have been reduced by four (4) blocks along Berry Street. The location of the deleted areas are: 1. 6th Street to Henderson Street and Travis to Jennings; and, WHEREAS, The Local Government was awarded TCSP funds from the Federal Highway Administration in the amount of $600,000. The Local Government wants to transfer these funds to another project along Berry Street, CSJ: 0902-48-490. This transfer will reduce the total amount of funding for this project by $600,000 to $892,080; and, NOW THEREFORE, in consideration of the premises and of the mutual covenants and agreements of the parties hereto, the State and the Local Government do agree as follows: AGREEMENT Article 1. Authorize the City Manager to accept a Transportation and Community and System Preservation (TCSP) grant from the Federal Highway Administration in the amount of $1,306,500 for improvements to portions of the North Main and Berry Street corridors and for a study of Central City commercial corridors; and 2. Authorize the City Manager to enter into a grant agreement with the Texas Department of Transportation for use of the TCSP grant funds; and 3. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Grants Fund by $1,306,500; and 4. Rescind M&C (G-12771), dated December 21, 1999, with Ordinance No. 14032, which estimated the grant award to be $1,500,000. DISCUSSION: In December, 1999, the City Council approved M&C (G-12771), authorizing the City Manager to submit a TCSP grant proposal to the Federal Highway Administration in order to receive an earmarked TCSP grant in the amount of $1.5 million. On March 17, 2000, the US Transportation Secretary announced the FY 2000 TCSP grant awards, which reduced all of the earmarked TCSP grant amounts. The City's grant amount was reduced by $193,500 to $1,306,500. Accordingly, the Federal Highway Administration (FHWA) has requested that the City submit a revised grant budget proposal. The City proposes to use $1 million in TCSP funds to supplement the 1998 CIP bond funds allocated to North Main Street ($1.56 million) and Berry Street ($1.5 million). The North Main Street project would receive $400,000 and the Berry Street project would receive $600,000 in TCSP funds to supplement bond funds for public improvements. The City proposes to use the remaining $306,500 to provide support for the economic development of other Central City commercial corridors. The high-priority corridors would be recommended by the City's Commercial Corridors Task Force. The redevelopment plans would identify potential funding sources and development tools. Appropriation Ordinance No. 14032 was adopted by the City Council on December 21, 1999, increasing estimated receipts and appropriations in the amount of $1,500,000 subject to the receipt of the grant. That appropriation ordinance should be rescinded.
