AMENDMENT TO CITY SECRETARY CONTRACT NO. 30747 STATE OF TEXAS § COUNTY OF TARRANT § THIS AGREEMENT is made and entered into by and between the City of Fort Worth, a home-rule municipal corporation situated in Tarrant and Denton Counties, Texas, acting herein by and through Joe Paniagua, its duly authorized Assistant City Manager, hereinafter called "City", and Boys & Girls Clubs of Greater Fort Worth, acting herein by and through its duly authorized executive director, hereinafter called "Director." WITNESSETH: 1. Amendment of Contract That the City and the Contractor, for and in good and valuable consideration of the mutual covenants and agreements contained herein do mutually covenant and agree that City Secretary Contract No. 30747, filed in the office of the City Secretary of Fort Worth, Texas, executed as of October 18, 2004 by City and Director ("Contract'), is hereby amended by amending the first sentence in Section 2. to increase the total funding amount contributed by the City of Fort Worth by $61,114.00 as approved by the City Council on April 26, 2005 (Mayor and Council Communication C-20680, City Secretary Contract Number 31824 and Ordinance Numbers 16400-04-2005 and 16401-04-2005) to read as follows: 2. It is understood and agreed that in no event shall the total distributions during the term of this agreement, consisting of federal grant funds from the Local Law Enforcement Block Grant in the amount of $301,151.00 and funds from the City of Fort Worth in the amount of$561,114.00 made to the Contractor exceed the total sum of$1,287,907.00. 2. Other Provisions Not Affected. Adopt the supplemental appropriation ordinance increasing appropriation in the General Revenue Fund by $61,114 and decreasing the unreserved, undesignated fund balance in the General Fund by the same amount; 2. Authorize the transfer of$61,114 from the General Fund to the Grants Fund from available funds; 3. Accept a donation from the Safe City Commission, not to exceed $10,000, with appreciation from the Council, to lease transportation for the new Comin' Up site; 4. Adopt the appropriation ordinance increasing estimated receipts and appropriations in the Grants Fund by $71,114 from available funds; and 5. Authorize the City Manager to execute and amend City Secretary Contract 30747 with the Boys and Girls Clubs of Greater Fort Worth to add an additional Comin' Up site at Rosen Heights Baptist Church. DISCUSSION: During a monthly Crime Update presentation given by Police Chief Mendoza on February 8, 2005, a map was shown that depicted where gang members lived and the location of Comin' Up sites. Police Chief Mendoza noted that there was a growing population of gang members on the north side of the city that would not use the closest Comin' Up center in Diamond Hill due to territorial issues with other gangs. On April 9, 2005, a shooting occurred between gang members in two different cars. As a result of the gunfire a 13 year old occupant of one vehicle was struck by a bullet and later died. The victim had relatives who are known members in one gang and the occupants of the other vehicle were part of what had become a rival gang. During a quarterly meeting of the Neighborhood Policing District Steering Committee, a group co-chaired by the Mayor and the United States Attorney for the Northern District of Texas, Chief Mendoza gave background information on this shooting to the group and brought representatives from the Comin' Up program. It was mentioned that a new facility was needed, possibly at the North Tri-Ethnic Center, to serve the gang that is on the west part of the northside. The group discussed adding a new site on an rush basis and Joe Cordova of the Boys and Girls Clubs of Greater Fort Worth said the site could be up and running in 3-4 weeks. Logname: 35COMINUPROSEN Page 1 of 2 During the March Crime Update the need for the site was mentioned and a follow-up presentation was given, by Council request, at the April 19th Pre-Council meeting. Following discussions with gang members on the north side the use of the North Tri-Ethnic Community Center was ruled out due to territorial issues and an alternative site, Rosen Heights Baptist Church, was located. Leaders of the church indicated they are amenable to a 3-year lease. To accelerate the opening of the center some equipment and supplies normally associated with a Comin' Up site will be acquired at a later date if continuation funding is available. Although the site is within walking distance for many of the gang members in the neighborhood the Safe City Commission has generously offered to provide up to $10,000 for lease and operation of a van to be used to transport participants to and from the Center and on other outings. The Center will have a Program Coordinator, two Outreach Specialists and contracted services and training when it opens. The Police Department, Comin' Up staff and Parks and Community Services Department believe that opening this center before the summer months will alleviate any potential violent scenarios between the various gangs on the northside. The Rosen Heights Baptist Church is located in COUNCIL DISTRICT 2. FISCAL INFORMATION/CERTIFICATION: The Finance Director certifies that upon approval of the above recommendations and adoption of the appropriation ordinances, funds will be available in the current operating budget, as appropriated, in the Grants Fund. The unreserved, undesignated General Fund fund balance will be $37,815,565 after the transfer.
