HomeMy WebLinkAboutContract 30750 AMENDMENT NO. 1 r STATE OF TEXAS b CITY SECRETARY CONTRACT NO. 0 0 (M&C Needed) COUNTY OF TARRANT $ WHEREAS, the City of Fort Worth (City) and Freese and Nichols, Inc. , (Engineer) made and entered into City Secretary Contract No. 29402, (the Contract) which was authorized by the City Council by M&C C-19872 on the 2nd day of December, 2003; and WHEREAS, the Contract involves engineering services for the following project: Engineering Contract for the design of Keller Water and Sanitary Sewer Transfer Study and Design. WHEREAS, it has become necessary to execute Amendment No. 1 to said Contract to include an increased scope of work and revised maximum fee; NOW THEREFORE, City and Engineer, acting herein by and through their duly authorized representatives, enter into the following agreement which amends the Contract: 1. Article I, of the Contract is amended to include the addition- al engineering services specified in M&C C-20282, adopted by the City Council on 21st day of September, 2004 , and further amplified in a proposal letter dated August 4, 2004 , copies of which are both attached hereto and incorporated herein. The cost to City for the additional services to be performed by Engineer total $134 ,074 .00. 2. Article II, of the Contract is amended to provide for an increase in the maximum fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall not exceed the sum of $301,147.00. 7 MINAE 3. City Secretary Contract Number 29402, DOE No. 4211 Dear Mr. Domenech: Attached is the revised engineering proposal for furnishing the City of Fort Worth the changes requested on the Keller water and sewer transfer. These changes are listed below. • Design of cut & plug at the Corning Plant • Design three cut &plug at Ray White and Alta Vista • Design of two service connections at the west end of Ray White • Design of 16" water line along Old Denton Rd. south of Prestige Court. • Design of 8" water line along Golden Triangle between Pecan Park and Katy Rd. • Design of 8" water line along Katy Rd. between Golden Triangle and Coffee Tree. • Design of 8" water line along N. Caylor Rd. and South of Sunset Cir. • Design of ring connection at Old Denton Rd. north of Mistys Run. • Design of ring connection at Ray White Rd. south of Wall Price Keller. • Design of ring connection at Alta Vista and Fir Dr. • Design bore for 8" water line crossing railroad at Wall-Price Keller • Subtract design of well site abandonment. We propose to provide the design and survey services for a fee of$134,074. Exhibits 1, 2, 3, and 4 provide a breakdown of the fee. TIP.9"FF�..:RC a YDi DATE: Tuesday, September 21, 2004 LOG NAME: 30KELLERWATER REFERENCE NO.: **C-20282 SUBJECT: Amendment No. 1 to Engineering Agreement with Freese and Nichols, Inc. for Keller Water and Sanitary Sewer System Transfer Study and Design RECOMMENDATION: It is recommended that the City Council authorize the City Manager to execute Amendment No. 1 to City Secretary Contract No. 29402 with Freese and Nichols, Inc. in the amount of $134,074 to provide for additional design and survey services, thereby increasing the contract amount to $301,147. DISCUSSION: On December 7, 1999, the cities of Fort Worth and Keller entered into a Memorandum of Understanding (MOU) related to the long-term provision of water to Keller by Fort Worth. Under the terms of the MOU, Keller and Fort Worth agreed to cooperate on the transfer to Fort Worth of a portion of Keller's water Certificate of Convenience and Necessity (CCN) located west of US Highway 377 and within the corporate limits and Extraterritorial Jurisdiction of Fort Worth. On July 11, 2000 (M&C C-18127), the City Council authorized the City Manager to execute an interlocal agreement with the City of Keller providing for the transfer of a portion of Keller's CCN and continue to provide water service to the area to be transferred for a period of time not to exceed five years. The five year time period began when the Texas Commission on Environmental Quality approved the CCN transfer, which was March 20, 2001. On December 2, 2003 (M&C C-19872), the City Council authorized the City Manager to execute an engineering agreement with Freese and Nichols, Inc. in the amount of$167,073.00 for the Keller Water and Sanitary Sewer System Transfer Study and Design. The purpose of the study was to identify the necessary improvements to be made to allow for the orderly transition of water and sanitary sewer facilities within the area to be transferred to Fort Worth. The completed study has identified the need to increase water reliability and delivery to the project area, which will require the installation of the following water main extensions: A 16-inch water line along Old Denton Road south of Prestige Court; 8-Inch water lines along Golden Triangle between Pecan Park and Kathy Road, Kathy Road between Golden Triangle and Coffee Tree, N. Caylor Road and south of Sunset Circle; and One 8-Inch water line railroad crossing at Wall-Price Keller. Freese and Nichols, Inc. proposes to provide the necessary design and survey services for the additional improvements for a lump sum fee of$134,074. City staff considers this amount to be fair and reasonable. http://www.cfwnet.org/council_packet/Reports/mc_print.asp 10/7/2004 Freese and Nichols, Inc. is in compliance with the City's M/WBE Ordinance by committing to 37% MNVBE participation on this amendment. The City's goal on this amendment is 18%. This project will be located in COUNCIL DISTRICT 2, Mapsco 22K, P, Q, U, V and Z; and 23A, S and J.
