HomeMy WebLinkAboutContract 31255 AMENDMENT NO. 2 f�1 -�?-05A'•- STATE OF TEXAS $ CITY SECRETARY CONTRACT NO.,�) YS (M&C Needed) COUNTY OF TARRANT $ WHEREAS, the City of Fort Worth (City) and Kimley-Horn and Associates, Inc. , (Engineer) made and entered into City Secretary Contract No. 29706, (the Contract) which was authorized by the City Council by M&C C-20000 on the 23th day of March 2004 and subsequently revised by one previous amendment; and WHEREAS, the Contract involves engineering services for the following project: Sanitary Sewer Rehabilitation Contract LXX (70) WHEREAS, it has become necessary to execute Amendment No. 2 to said Contract to include an increased scope of work and revised maximum fee; NOW THEREFORE, City and Engineer, acting herein by and through their duly authorized representatives, enter into the following agreement which amends the Contract: 1 . Article I, of the Contract is amended to include the addition- al engineering services specified in M&C C-20486, adopted by the City Council on 11th day of January 2005, and further amplified in a proposal letter dated November 23, 2004 , copies of which are both attached hereto and incorporated herein. The cost to City for the additional services to be performed by Engineer total $39,935.50. 2 . Article II , of the Contract is amended to provide for an increase in the maximum fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall not exceed the sum of $511 ,015.00. 29 fl, nKi ORIGINAL 3. The 30" line is located in a storm sewer tunnel below the NAS Fort Worth Joint Reserve Base (see Exhibit 1). The supports and straps were put in place to provide protection and restraint to the pipe line, specifically during heavy storm flow through the tunnel. The City has requested we provide design services that would secure this sanitary sewer line within the tunnel. We, therefore, respectfully request an amendment to our contract to provide services as outlined in the following tasks. The scope of services for this amendment is divided into the following tasks: • Task 1 —Analyze future capacity requirements of Line M-199. • Task 2 — Design, bidding and construction phase services for the proposed rehabilitation as instructed by the City of Fort Worth. The scope of services associated with each task is as follows: • Task 1 — Analyze future capacity requirements of Line M-199 which includes: o Approximating the future capacity needs of western Fort Worth, including the Chapel Creek area and other western development, based on an acreage assessment from aerial photography. We will also review flow meter data provided by the City of Fort Worth for the City of White Settlement. /1 1 TEL 817 335 6511 FAX 817 335 5070 _ Kimley-Horn Mr.Liam Conlon,November 23,2004,Page 2 and Associates, Inc. • Task 2 - Design, bidding and construction phase services for the proposed rehabilitation as instructed by the City of Fort Worth which includes: o Provide information to the City regarding design recommendations. We anticipate the solution to be completion of concrete encasement for the 30-inch sanitary sewer line. In preparation for encasement, we anticipate intermittent straps and replacement supports to secure and level the existing 30- inch sanitary sewer line o Review the permit and procedure regarding construction on the M-199 Line at the NAS Fort Worth JRB. o Provide design that is in compliance with construction requirements at the NAS Fort Worth JRB. o Allow for review and comment of the plans by the NAS Fort Worth JRB prior to bidding. o Preparation of bidding and construction contract documents. o Attend the project Bid Opening. Prepare bid tabulation following the bid. o Attend a Pre-Construction Conference prior to commencement of Work at the Site. o Conduct a final site visit to determine if the completed Work of Contractor is generally in accordance with the Contract Documents and the final punch list so that ENGINEER may recommend, in writing, final payment to Contractor. Accompanying the recommendation for final payment, ENGINEER shall also provide a notice that the Work is generally in accordance with the Contract Documents to the best of ENGINEER's knowledge, information,and belief and based on the extent of the services provided by ENGINEER under this Agreement and based upon information provided to ENGINEER upon which it is entitled to rely. Construction Phase Services will not include services related to inspections or testing, applications for payment, disagreements between the City and the Contractor, or determination of substantial completion. We recommend that the City increase the contract amount by$39,935.50 for these additional services. Amendment 2: $39,935.50 Revised Contract: $511,015.00 Kimley-Horn will subcontract a portion of these services to Alphagraphics #83, an M/WBE subconsultant. The amount we will be subcontracting is $1,100.00. This represents an M/WBE participation percentage of 2.75% for these additional services. With these Additional Services, our revised contract amount will be $511,015. This will revise our total contract M/WBE participation from $128,810(27.3%) to 129,910 (25.42%). Authorize the transfer of $39,935.50 from the Water and Sewer Operating Fund to the Sewer Capital Projects Fund; 2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriation in the Sewer Capital Projects Fund in the amount of$39,935.50 from available funds; and 3. Authorize execution of Amendment Number 2 to engineering agreement with Kimley-Hom and Associates, Inc. DISCUSSION: On March 23, 2004 (M&C C-20000), the City Council authorized the City Manager to execute an engineering agreement with Kimley-Hom and Associates, Inc. in the amount of $408,450.00 for the design of sanitary sewer rehabilitation Contract LXX (70). The contract was previously revised by one amendment (M&C C-20334, October 12, 2004) in the amount of$62,629.50 for the necessary design to replace sanitary sewer main M-134R located within Union Pacific Railroad property. Amendment Number 2 will allow Kimley-Horn and Associates, Inc. to provide the necessary design for the replacement of a deteriorated sanitary sewer main M-199R* located underneath the runway of the Naval Air Force Station (NAS) Fort Worth Joint Reserve Base and immediately upstream of project sewer main M- 134R. The identified sewer main structural supports deteriorated further during the heavy rainfall in the months of June and July 2004. Kimley-Hom and Associates, Inc. proposes to provide the necessary additional engineering services for a lump sum fee of$39,935.50. Staff considers this amount to be fair and reasonable.
