HomeMy WebLinkAboutContract 31261 . 01-31-05P01 : 15 RCVD AMENDMENT TO PROFESSIONAL SERVICES CONTRACT No M&C Required STATE OF TEXAS § CITY SECRETARY COUNTY OF TARRANT § Contract No. I 4)a WHEREAS, the City of Fort Worth (City) and Compliance Partners, Inc. (Consultant) made and entered into City Secretary Contract No. 29866, the "Contract") on the 13`h day of April 2004; and WHEREAS, the Contract involves professional services for the following project: Management of Air Quality Permitting and Operating Compliance Services for Village Creek Wastewater Treatment Plant WHEREAS, it has become necessary to amend said Contract to include an increased scope of work and modify the termination date; NOW THEREFORE, City and Consultant, acting herein by and through their duly authorized representatives, enter into the following agreement which amends the Contract: 1. Attachment A as referenced in Paragraph 1 of the Contract is amended to include the additional professional services specified in a proposal letter dated November 30, 2004, a copy of which is attached hereto and incorporated herein. The cost to City for the additional services to be performed by Consultant is included in the original contract amount of $98,580.00 and no additional compensation above such amount shall be incurred. 2. Paragraph 3 of the Contract is amended to be and read as follows: The term of this agreement shall commence upon its execution and conclude on September 30, 2005, unless terminated earlier as hereinafter provided. 3. All other provisions of the Contract, which are not expressly amended herein, shall remain in full force and effect. Professional Engineer City of Fort Worth 4500 Wilma Lane Arlington, TX 76012 Re: Contract No. 29866 Amendment Dear Madeline: This document is intended to provide an amended scope of work to the above referenced contract to include additional services requested by the City of Fort Worth. Additionally, we request that Item #3, Term, of the original contract be removed. We will designate this correspondence Attachment C for identification purposes. The following services requested by the City shall be provided on a time and materials basis at our standard rates, not to exceed the original contract amount: Task 6:Title V Air Permit Renewal This is a continuation of Task 3 and includes: a. Complete the permit renewal application for submittal to the TCEQ b. Meetings, as necessary with City of Fort Worth personnel and agency personnel Task 7: Prepare Emissions Inventory for Fiscal Year 2006 Task 7 will include the following: a) Gather the required operating hours for combustion sources. b) Review emission factors for combustion sources. c) Obtain 2004 plant throughput and influent water analysis for Water 9 modeling. d) Completion and updating of Emission Inventory forms e) Submittal of FY 2006 Emission Inventory Questionnaire to the appropriate TCEQ office. f) Preparation and submittal of fee basis summary form to TCEQ in timely fashion. Task 8: Title V Deviation Reports Task 8 will include two deviation reports and one annual Compliance Certification as required by the conditions of the plant FOP (Federal Operating Permit). Work involved is expected to include the following: a) Complete review of plant operations to verify compliance with plant FOP for each reporting period. b) Complete Deviation reports in required format for submission to City of Ft. Worth in a timely manner. c) Complete Annual Compliance Certification in required format and in a timely manner for submission to City of Ft. Worth. Task 9: Compliance Review Task 9 will include meetings necessary to complete the work associated with the Task 6 through 8 described above. a) Meetings as required to review air compliance status and assist plant personnel in satisfying requirements. b) Any required documentation and correspondence for changes to any plant "permit by rule" conditions. c) Respond to any other minor Air Compliance issues or questions associated with plant operations, EIQ submittal, or TCEQ requests. d) Make necessary changes to compliance documents. Task 10: Semi-Annual (Quarterly) Stack Testing {Turbines) Task 10 will involve the activities necessary to comply with the special condition #11 of Permit 97553, as amended. In accordance with Special Condition #11, a request has been made to the TCEQ to permit semi-annual stack sampling. Work involved with this task is anticipated to include the following: a) Semi-annual gas turbine stack checks for NOX CO, and OZ per special condition #11 of permit #7553 beginning in February 2005. Excluded Items The following items have been identified as work or assistance that is not included in the scope of work described above: • Public notice expenses (other than oversight), such as newspaper publishing, manufacturing of signs • Day-to-day monitoring, reporting and record keeping • Sampling and laboratory analysis costs, with the exception of those specifically included. • All SARA and TSCA regulatory requirements • All fees 2 n . Should the City of Fort Worth request assistance with these items or any other items not included in the Task 1 through 10 Scope of Work, Compliance Partners Inc will provide an estimate of the work effort and request authorization from the Village Creek plant management.
