HomeMy WebLinkAboutContract 45703-A1 1TY SECRUARY °��fTE��4CT AIO. y -1 AMENDMENT TO FIRE SERVICES AGREEMENT BETWEEN CITY OF FORT WORTH AND CITY OF WESTWORTH VILLAGE STATE OF TEXAS § COUNTY OF TARRANT § WHEREAS, the City of Fort Worth ("Fort Worth") and the City of Westworth Village ("Westworth Village") entered into a Fire Services Agreement on June 30, 2014 (Fort Worth City Secretary Contract No. 45703) ("Agreement") pursuant to Chapter 791 of the Texas Government Code, for Fort Worth to provide Fire Services, as defined in the Agreement, to Westworth Village within a designated service area; WHEREAS, Westworth Village desires to receive additional fire services from Fort Worth, as set forth herein below, and Fort Worth agrees to provide such services; and WHEREAS, Fort Worth and Westworth Village desire to specify the terms and conditions of an amendment to the Agreement for the provision of the services; NOW, THEREFORE,KNOW ALL BY THESE PRESENTS: This amendment to the Agreement ("Amendment") is entered into by and between Westworth Village, a Type A General Law municipality in Tarrant county, acting through its duly authorized Mayor, and Fort Worth, a home-rule municipality, acting through Charles Daniels, its duly authorized Assistant City Manager; and WITNESSETH: 1. SERVICES. Section 1 of the Agreement is hereby deleted in its entirety and amended as follows: 1. SERVICES; SERVICE AREA. (a) Fort Worth will provide Level 3 fire services (as defined in Attachment "C", attached hereto and made apart hereof for all purposes) ("Fire Services") to -;a Westworth Village in the service area, the exact location of which is i, designated in a location map marked Attachment "A," attached hereto and made a part hereof for all purposes ("Service Area"). It is recognized and understood that Fort Worth cannot and does not assume responsibility for the r� provision of Fire Services outside the Service Area. (b) Fort Worth will provide other fire-related services set forth on Attachment "D", attached hereto and made apart hereof for all purposes ("Fire-Related Cam,, Services"). 0 Amendment to Fire Services Agreement OFFICIAL RECORD Between Fort Worth and Westworth Village CITY SECRETARY Page 1 of 3 FT. WORTH, TX 2. COMPENSATION. Section 5 of the Agreement is hereby amended by adding the following after the first paragraph: "For the Fire-Related Services, and in addition to the amounts set forth in Attachment `B", Westworth Village shall pay Fort Worth the annual amount of $22,190.00, provided that the number of commercial inspections do not exceed fifty in a contract year(from July 1 to June 30). If commercial inspections exceed fifty in a contract year, the parties agree that the compensation for the Fire- Related Services shall be renegotiated to a higher amount. Additional costs related to plan review will be billed by Fort Worth directly to the State-licensed contractors performing the installation or renovation to fire protection systems using the fee schedule in the City of Fort Worth Fire Code Section I102." 3. NO FURTHER AMENDMENT. All terms and conditions of the Contract not amended herein remain unaffected and in full force and effect, are binding on the Parties and are hereby ratified by the Parties. Capitalized terms not defined herein shall have meanings assigned to them in the Contract. Page 2 of 3 CITY SECRETARY F'6''.WORTH,TX ATTACHMENT "D" FIRE-RELATED SERVICES Fire-Related Services Provided to Westworth Village: 1. Annual inspection of commercial occupancies. 2. Annual inspection of residential State-licensed group homes per State requirements. 3. Annual inspection of residential State-licensed home daycares per State requirements. 4. Permitting,plan review and acceptance testing of new/altered fire protection systems (fire alarm, sprinkler, standpipe, access control). 5. Response to complaints and inquiries regarding fire safety issues(overcrowding, blocked exits,open flame, etc.). 6. Fire Safety Education outreach to juvenile and elderly population excluding CPR and drowning prevention. 7. Single family residential smoke detector installation program to non-rental properties Annual Requirements from Westworth Village: 1. Submit an annual list of occupancies to Fort Worth identifying all commercial and residential properties. 2. Submit to Fort Worth an annual plot denoting all areas of city boundary and structures therein. 3. Retain an adopted fire code for reference by Fort Worth inspectors (currently NCTCOG Option B amendments to the 2009 International Fire Code). 4. Submit to Fort Worth annual fire hydrant test reports. Services Detail: • Fort Worth inspection services shall be performed by TCFP-certified Inspector Basic Fort Worth Fire Department personnel. • Enforcement actions will be referred to Westworth Village for processing within their municipal court with Fort Worth Inspectors providing witness and evaluation of alternate compliance methods. DISCUSSION: On June 30, 2014, City Council approved execution of a Fire Services Agreement with Westworth Village (M&C C-26821/City Secretary Contract No. 45703). The Agreement authorized the City of Fort Worth Fire Department to provide fire suppression services within the City of Westworth Village for an annual fee amount of$266,277.00. The City of Westworth Village has notified the City of Fort Worth of its desire to expand the Agreement beyond fire suppression to include the following services: Fire inspections of commercial occupancies and other state-licensed facilities; Plan review and permitting of fire protection systems; Response to complaints and inquiries regarding fire safety issues; Fire safety education outreach to juvenile and elderly populations; and Single family residential smoke detector promotion activities. For these additional services, the City of Westworth Village shall pay the City of Fort Worth the amount of$22,190.00 annually provided that the volume of required commercial inspections does not exceed 50 in a contract year. If commercial inspections exceed 50 in a contract year, the parties agree that the compensation shall be renegotiated to a higher amount. This Fire Services Agreement amendment will commence upon execution and expire with the original Agreement on June 30, 2015. FISCAL INFORMATION/CERTIFICATION: The Financial Management Services Director certifies that the Revenue Division of the Fort Worth Fire Department is responsible for the collection of funds due to the City under this Agreement.
