This is a request to the Director of the Water Department of the City of Fort Worth for water and/or sanitary sewer
service outside the city limits of Fort Worth, pursuant to City Code Section 35-60.

understand that the provision of water by the City of Fort Worth shall be made in strict compliance with Chapter 35 of
the Fort Worth City Code (1986), as amended, specifically but not limited to the following Sections:
1. City Code Section 35-60"Uses Outside City"as applicable; and
2. City Code Section 35-20"Provisions Incorporated into Consumer Contracts" as applicable; and
"All of the provisions of this Chapter[35] shall be deemed to be incorporated in every contract between the city
and its water or sanitary sewerage service customers, and each customer or consumer shall be charged with
knowledge of the provisions of this chapter and, by applying for and accepting water or sanitary sewerage
service from the city, to have assented to the provisions of this chapter."This shall include any and all
ordinances adopted and amending Chapter 35 such as ARTICLE VI. LAWN AND LANDSCAPE IRRIGATION
CONSERVATION.
3. City Code Section 35, Article III "Charges"as applicable; and
The owner understands that he/she is responsible for any related impact fees, tap fees, meter deposits,front foot
charge, per acre charge,water main capacity charge and extension under CFA or miscellaneous project. Please
obtain the amount to these charges from the Fort Worth Water Development Section.
4. City Code Section 26-2 A 01.2 as applicable; and
The owner needs to apply for a plumbing permit with the Fort Worth Planning & Development Department to
connect to the City of Fort Worth water and/or sanitary sewer lines despite the property is in the county.
5. City Code Section 12.5,Article V"Public Drinking Water"and Chapter 35, Article VII "Installation & Maintenance
of Irrigation System"as applicable; and
The owner is responsible for the installation of backflow devices, obtaining permit through the Fort Worth Planning
and Development Department and test the devices annually according to this section of the city code for both
domestic and irrigation systems.

6. Local Government Code Sec. 212.012. "Connection of Utilities, Platting Requirement"as applicable.
An entity may not serve or connect any land with water, sewer, electricity, gas, or other utility service unless the entity
has been presented with or otherwise holds a certificate applicable to the land issued under Section 212.0115.
Under this section the property is required to be platted in order to receive service.

SUBJECT: Authorize Agreement for the Provision of Water and Sanitary Sewer Service at 1.25 Times
the Retail Rate to Serve a Charter School Located at the Northwest Corner of Harmon
Road and Golden Heights, in Unincorporated Tarrant County, Pursuant to City Code
Section 35-60B, Uses Outside City (ADJACENT TO COUNCIL DISTRICT 2)
RECOMMENDATION:
It is recommended that the City Council authorize an Agreement for the Water Department to provide
water and sanitary sewer service at 1.25 times the retail rate to serve a Charter School located at the
northwest corner of Harmon Road and Golden Heights, in unincorporated Tarrant County, pursuant
to City Code Section 35-60B.
DISCUSSION:
Mr. Kenneth Saunders, the owner of the Charter School located at the northwest corner of Harmon
Road and Golden Heights, has submitted a request to receive water and sanitary sewer service from
the City of Fort Worth for the benefit of Charter. The legal description of the property is: Lots 1 and 2,
Block 1 of I.L. Texas HS Addition, located in the Extraterritorial Jurisdiction of Fort Worth, inside
Tarrant County and within the Fort Worth Water Certificate of Convenience and Necessity (CCN).
Mr. Kenneth Saunders has agreed to pay all fees and charges associated with the connection. The
applicant also understands that the fees and the monthly bill will be 1.25 times the rate for customers
inside the City of Fort Worth.
This property is located adjacent to COUNCIL DISTRICT 2, Mapsco 21 J, 21 K, 21 N and 21 P.
FISCAL INFORMATION/CERTIFICATION:
The Financial Management Services Director certifies that the Water Department is responsible for
the collection and deposit of funds due to the City.
