COUNTY OF TARRANT $ WHEREAS, the City of Fort Worth (City) and Dunaway Associate Inc. , (Engineer) made and entered into City Secretary Contract No. 23615, (the Contract) which was authorized by the City Council by MSC C-16586 on the 10th day of February, 1999; and WHEREAS, the Contract involves engineering services for the following project: Engineering contract for the design of Mains 64, 64R, 180, 180R and 445 Drainage Area Sanitary Sewer System Rehabilitation and Improvements (Group 3, Contract 2) Part 5. WHEREAS, it has become necessary to execute Amendment No. 1 to said Contract to include an increased scope of work and revised maximum fee; NOW THEREFORE, City and Engineer, acting herein by and through their duly authorized representatives, enter into the following agreement which amends the Contract: 1. Article I, of the Contract is amended to include the addition- al engineering services specified in MSC C-17919, adopted by the City Council on 21st day of March, 2000, and further amplified in a proposal letter dated January 18, 2000, copies of which are both attached hereto and incorporated herein. The cost to City for the additional services to be performed by Engineer total $59,906.78. 2. Article II, of the Contract is amended to provide for an increase in the maximum fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall not exceed the sum of $345,260.78. FOR MAINS 64, 64R, 180, 180R AND 445 DRAINAGE AREA SANITARY SEWER SYSTEM REHABILITATION AND IMPROVEMENTS (GROUP 3, CONTRACT 2) PART 5 RECOMMENDATION: It is recommended that the City Council authorize the City Manager to execute Amendment No. 1 to City Secretary Contract (No. 23615) with Dunaway Associates, Inc. in the amount of$59,906.78 to provide for additional design and survey services, thereby increasing the contract amount to $345,260.78. DISCUSSION: On February 10, 1998 (M&C C-16586), the City Council authorized the City Manager to execute an engineering agreement with Dunaway Associates, Inc. in the amount of $285,354.00 for the preparations of plans and specifications for Mains 64, 64R, 180, 180R and 445 Drainage Area Sanitary Sewer System Rehabilitation and Improvements (Group 3, Contract 2) Part 5. The project is generally bound on the north by Colonial Parkway, on the east by McCart Street, on the South by Gambrell Avenue and on the west by Overton Park Drive. It has been determined that an additional 3,500 linear feet of severely deteriorated sewer lines located within the project area must be replaced in order to alleviate sewer backup problems to customers. Due to the close proximity of the identified sewer lines to this project, staff recommends that Dunaway Associates, Inc.'s contract be amended to provide the necessary design services. The change order will also allow the entire project to be divided into three individual contracts for advertising purposes in order to expedite construction of the project. In addition, the change order will allow for the preparation of additional permanent and temporary construction easements and temporary right-of-entry agreements needed on the project. Staff considers Dunaway Associates, Inc.'s proposed fee to be fair and reasonable for the additional services to be provided. Dunaway Associates, Inc. is in compliance with the City's M/WBE Ordinance by committing to an additional 25% M/WBE participation on this amendment.
