Home My WebLink AboutContract 11624 SECOND AMENDMENT TO CITY SECRETARY CONTRACT NO. 6523 STATE OF TEXAS § CITY SECRETAR9 COUNTY OF TARRANT § CONTRACT No RECEIVED � I MAR 30 1981 WHEREAS, on May 4, 1970, the City of Fort Worth and th arrant County Junior College District entered into a lease of 43,90 uare feet of land for use by the District as a site for an aeronau aC�� technology facility at Meacham Field, said lease being (known as City Secretary Contract No. 6523, on file in the office of the City Secretary of the City of Fort Worth; and WHEREAS, on June 27, 1978, said City Secretary Contract No. 6523 was amended to add 6,624 square feet of land for use by the District as an aircraft parts storage yard, said amendment being known as City Secretary Contract No. 9911, on file in the office of the City Secretary of the City of Fort Worth; and WHEREAS, the City of Fort Worth and the Tarrant County Junior College District desire to again amend said City Secretary Contract No. 6523, as amended, to add 30,452 square feet of unimproved land to be used for automobile parking; NOW, THEREFORE, KNOW ALL MEN BY THESE PRESENTS: The City of Fort Worth, a municipal corporation located in Tarrant County, Texas, acting through its duly authorized City Manager, Robert L. Herchert, hereinafter called "Lessor", and the Tarrant County Junior College District, acting through its duly authorized President, Joe B. Rushing, hereinafter called "Lessee", do hereby covenant and agree as follows: 1. City Secretary Contract No. 6523, as amended, on file in the office of the City Secretary of the City of Fort Worth, is hereby further amended by adding to the ground area leased thereunder the following described land: Two tracts of land comprising a total of 30,452 sgi4are feet, contiguous to the southern and eastern boundaries of the premises leased under City Secretary Contract No. 6523, said sites being known as lease sites "D" and "E" and being described more particularly in fields notes marked Exhibit "A-1" and "A-2", respectively and outlined in red on the plat marked Exhibit "B". All exhibits are attached hereto and incorporated herein for all purposes incident to this agreement. OFFICIAL RECORD CITY SECRETARY FT. WGRTH, TEX. 2. City Secretary Contract No. 6523, as amended is further amended by increasing the annual rental due thereunder by Two Thousand Four Hundred Thirty-Six and 16/100 Dollars ($2,436.16) . The additional rental is calculated at the following rate: Eight cents ($.08) per square foot per year for the additional premises leased hereunder, as described in Exhibits "A-1" and "A-2", attached hereto, said areas containing a total of 30,452 square feet. Said additional ground rental shall be payable in advance at the office of the Airport Manager at Meacham Field in regular monthly installments coinciding with the other monthly rental payments set forth in City Secretary Contract No. 6523, as amended. 3. The term of this amendment shall begin on April 1, 1981 and shall last so long as City Secretary Contract No. 6523 remains in force and effect. 4. All terms, provisions and conditions of City Secretary Contract No. 6523 (as previously amended) which are not amended hereby, shall remain unchanged and in full force and effect, and, where applicable will apply to this amendment the same as if written in a single instrument. ' Of Tarrant Cqunty Junior College District leases, City Secretary Contract No. 6523, 50,524 sgtwre feet of land on the west side of Meacham Field. The college's aeronautical technology facility was constructed on the land in 1970. Tarrant County Junior College seeks to add to its lease approximately 30,700 square feet of unimproved land which it proposes to pave for automobile parking space. A survey has been ordered to determine the exact measurements, however based on preliminary figures the annual rental rate will be increased by approximately $2,456 when calculated at $.08 per square foot per year. All other conditions of the existing lease will remain unchanged. The amendment will become effective March 1, 1981. When contacted by telephone on February 17, 1981, the Aviation Advisory Board unanimously recommended approval of the lease amendment. Recommendation It is recommended that the City Council authorize the City Manager to execute an amendment to the lease with Tarrant County Junior College District to add automobile parking space as described above.
