RENEWAL OF CONTRACT FOR FOOD AND BEVERAGE SALES AND
MISCELLANEOUS SERVICES AT WILL ROGERS MEMORIAL CENTER,
FORT WORTH, TEXAS
WHEREAS, the City Fort Worth, Texas (City) and Ken Moore Enterprises
Company (Contractor) entered into City Secretary Contract No. 14255, a contract for
food and beverage sales and miscellaneous services, on April 1, 1985; and
WHEREAS, City and Contractor subsequently renewed and extended Contract
No. 14255 by their execution of City Secretary Contract No. 19610 on April 1, 1993; and
WHEREAS, Contract No. 19610 is for a five (5) year primary term ending
March 31, 1998, with options for five (5) one-year renewal terms at City's option; and
WHEREAS, the City Council, by its adoption of M&C C-16279 on September 9,
1997, authorized the first one-year renewal of the contract effective April 1, 1998;
WHEREAS, the City Council, by its adoption of M&C C-17270 on February 9,
1999, authorized the second one-year renewal of the contract effective April 1, 1999;
NOW, THEREFORE, this Agreement is made and entered into by and between
City, acting by and through its duly authorized Assistant City Manager, and Contractor,
acting by and through its duly authorized representative:
1. EXTENSION OF CONTRACT.
Pursuant to Section 4.02 of City Secretary Contract No 14255, as amended by

City Secretary Contract No. 19610 (hereafter collectively referred Las "the Contract"),
City hereby extends the Contract for a one-year renewal term beginning April 1, 2000,
and ending March 31, 2001.

2. OTHER TERMS AND CONDITIONS.
All other terms and conditions of the Contract, as amended, shall continue in
force and effect during the renewal term.

SUBJECT EXERCISE OF OPTION TO RENEW WILL ROGERS MEMORIAL CENTER FOOD AND
BEVERAGE CONTRACT WITH KEN MOORE ENTERPRISES, INC. FOR ONE YEAR
RECOMMENDATION:
E It is recommended that the City Council authorize the City Manager to execute a one-year renewal
option to City Secretary Contract (No. 14255), subsequently renewed and extended by City Secretary
Contract (No. 1961.0) on April 1, 1993, with Ken Moore Enterprises, Inc. to provide concessions at the
Will Rogers Memorial Center complex beginning April 1, 2000, and ending March 31, 2001.
DISCUSSION:
Ken Moore Enterprises, Inc. is a local firm, owned by Elizabeth Moore, which has a long history of
concessions, catering and promotional ties to the Will Rogers Memorial Center. The original contract,
issued in 1984, was renewed and extended on April 1, 1993, by the execution of City Secretary
Contract (No. 19610). The renewal was for a five-year period, with five additional one-year renewal
options.
Ken Moore Enterprises, Inc. will continue to pay the current, established percentages on sales, as well
as a $50,000 per year lump sum payment, to the Will Rogers Memorial Center Special Marketing Fund,
as outlined in the present contract.
Ken Moore Enterprises, Inc. has performed satisfactorily; therefore, the option is recommended due to
past performance under the terms of the contract.
F FISCAL INFORMATION/CERTIFICATION:
The Public Events Department is responsible for the collection of funds due to the City- under this
agreement.
