WHEREAS, the City of Fort Worth (City) and J.B. Davies, Inc. ,
(Engineer) made and entered into City Secretary Contract No. 23667,
(the Contract) which was authorized by the City Council by M&C C-
16626 on the 24th day of February 1998; and subsequently revised by
six previous amendments; and
WHEREAS, the Contract involves engineering services for the
following project:
Engineering contract for the design of Main 170 Drainage Area
Sanitary Sewer Main 226 and 227, Lateral 1616 and 1635
Rehabilitation.

WHEREAS, it has become necessary to execute Amendment No. 3 to
said Contract to include an increased scope of work and revised
maximum fee;
NOW THEREFORE, City and Engineer, acting herein by and through
their duly authorized representatives, enter into the following
agreement which amends the Contract:
1.
Article I of the Contract is amended to include the additional
engineering services specified in a proposal letter dated March 31,
2000, a copy of which is attached hereto and incorporated herein.
The cost to City for the additional design services to be performed
by Engineer total $3,893 .07.

Article II of the Contract is amended to provide for an
increase in the maximum fee to be paid to Engineer for all work and
services performed under the Contract, as amended, so that the
total fee paid by the City for all work and services shall not
exceed the sum of $442 ,433 .51.

All other provisions of the Contract which are not expressly amended
herein shall remain in full force and effect.

Dear Mike:
We appreciate the opportunity to present this proposal and fee schedule for you consideration.
Pursuant to the completed television inspection work in the M-170 basin and as directed by Mr. Kuo-Ching
"Peter" Fu, P.E. of the Fort Worth Water Department we are submitting this request to design additional
footage of Lateral 1635. This design will be added to the construction plans delveloped for the above
referenced project. Attached please find construction cost estimates and exhibits depicting the additional
sewer line to be rehabilitated.

RE: DESIGN FEE AMENDMENT NO. 3 TO MAIN 170 DRAINAGE
AREA SANITARY SEWER MAIN 226 AND 227, LATERAL 1616
AND 1635 REHABILITATION DOE NO. 2765
The proposed amendment will reimburse J.B. Davies, Inc., for the additional engineering
services that will be provided on the project as requested by the City.
Subsequent to television inspection of the project it was revealed that lateral L-1635 had
severe defects and was experiencing infiltration. As the line is contiguous with the exist-
ing plans under development, it was decided to include these additional 348 linear feet of
sanitary sewer line to the scope of the project to correct this condition. Upon direction
from City staff J.B. Davies, Inc. conducted additional survey and has augmented their
design submittal to reflect this additional linear footage.
J.B. Davies, Inc., has requested a fee of$3,893.07 for the additional services to be pro-
vided thereby increasing the contract fee from $438,540.44 to $442,433.51. I believe this
fee is fair and reasonable for the additional services that were provided.
Please authorize the additional design fee by your signature on the attached contract
amendment form.
