HomeMy WebLinkAboutContract 25885 t CITY SECRETARY CONTRACT 1Z, o� AMENDMENT NO. 1 STATE OF TEXAS CITY SECRETARY CONTRACT NO. 23554 (No M&C Needed) COUNTY OF TARRANT WHEREAS, the City of Fort Worth (City) and Carter & Burgess, Inc. , (Engineer) made and entered into City Secretary Contract No. 23554 (the Contract) which was authorized by the City Council by M&C C-16554 on the 20th day of January, 1998; And WHEREAS, the Contract involves engineering services for the following project : Engineering services to develop a Northeast Fort Worth Regional Mobility Study. WHEREAS, it has become necessary to execute Amendment No. 1 to said Contract to include an increased scope of work and revised maximum fee; NOW THEREFORE, City and Engineer, acting herein by and through their duly authorized representatives, enter into the following agreement which amends the Contract : 1. Article I, of the Contract is amended to include the additional engineering services specified in a proposal letter dated March 30, 2000, a copy of which is attached hereto and incorporated herein. The cost to City for the additional services to be performed by Engineer total $11, 761 . 2 . Article II, of the Contract is amended to provide for an increase in the maximum fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall not exceed the sum of $162, 643 . Transportation and Public Works Department City of Fort Worth 1000 Throckmorton Street Fort Worth, Texas 76102 Reference: Fort Worth City Secretary Contract No. 23554 Amendment One Dear Mr. Walsh: Carter and Burgess is requesting that you process contract amendment number one for professional engineering services in the amount of$11,761.00. This amendment represents the services required to modify the Northeast Fort Worth Mobility Study as requested by Denton County representatives Michael Starek and John Polster and approved by the City of Fort Worth. The original contract between Carter& Burgess and the City of Fort Worth was executed by the City on January 20, 1998 for the not-to-exceed fee of$150,882 (including reimbursables). The amendment as submitted on November 1, 1999 represents services required to modify the report and technical documentation to reflect the demographic modifications as submitted for inclusion by Denton County. The Denton County share of the supplemental service request is $7,056.60 or sixty percent (60%) of the work effort, and the City of Fort Worth share is $4,704.40, or forty percent (40%) of the project budget amendment. WU081971960%CONTRAC Et EXHIBIT "A" SCOPE OF WORK NORTHEAST FORT WORTH REGIONAL MOBILITY STUDY AMENDMENT ONE -ADDITIONAL SERVICES PROJECT PARAMETERS The following assumptions pertain to the provision of Basic Services: A. The CLIENT for this project is the City of Fort Worth. B. These services are being provided for submittal to the City of Fort Worth Transportation and Public Works Department, Denton County, and the North Central Texas Council of Governments on the behalf of the CITY OF FORT WORTH, Texas. C. Analysis will be based on the latest roadway plan, at the time of this proposal. D. Demographic information will be provided by Denton County and approved by the City of Fort Worth. E. Daily traffic volume counts needed for model calibration will be obtained from the North Central Texas Council of Governments or provided by the City of Fort Worth or its representative(s). F. The ENGINEER will work on behalf of the CITY OF FORT WORTH in obtaining data required to perform this SCOPE OF SERVICES from outside agencies and governmental bodies. Task I Reconcile 2020 Population and Employment Forecasts 1.1 Prepare a technical memorandum which will include: (1) details of the differences in population and employment estimates used in the future year used by the CITY OF FORT WORTH and North Central Texas Council of Governments; (2) changes in general travel patterns; and (3) the process and procedures adopted by NCTCOG to adjust regional employment and population estimates. Five (5) copies of this technical memorandum will be submitted to CFW. 1.1.1 Analyze population and employment: 1.1.1.1. Document differences: 1.1.1.2. Calculate Pop./Emp. Task : Additional Services Carter& Burgess, Inc., anticipates that Additional Services may be necessary to complete this project. The tasks stipulated in this section are specifically excluded from the scope. In the event these additional services are required, a scope of services and any fee for additional services shall be agreed upon between CLIENT and ENGINEER in advance of services beingaccomplished; ccomplished; and the Agreement shall be amended. These services include but are not limited to the following: 5.1 Any meetings between CLIENT, CLIENT representatives, and/or as directed by CLIENT which are not included in this scope of work. 5.2 Automatic 24 Hour Traffic Counts (Calibration of the Base Year Model); 5.3 Adjustments to the Automatic 24 Hour Traffic Counts to adjust them to base year conditions; and 5.4 Any additional intersection manual turning movement counts that may be required by the CFW or others. 5.5 Additional scenario analyses at the direction of the CFW. 5.6 Additional revisions to the model due to changes in land use plans, traffic patterns, and/or recommendations from CFW or their representatives; 5.7 Any additional analysis (PASSER 11-90, TRANSYT-717) that may be required by the CFW or governmental agencies having jurisdiction over the development of this study. Northeast Fort Worth Regional Mobility Study Page 2 Transportation Engineering Services Proposal 7196000.AsI a ODD orf g� EXHIBIT "B" COMPENSATION 1.1 FEE/COMPENSATION FOR SERVICES AND REIMBURSABLE EXPENSES Direct Labor: A Retainer fee is not required for this project. Direct labor to complete the transportation planning services described in Task 1.0 through Task 4.0 with the exception of meetings beyond those allowed herein would be completed on an hourly fee basis not-to-exceed $11,761. Direct labor to complete Task 5.0, as authorized by the CLIENT, will be conducted on an hourly basis as shown in Exhibit "D" of the based agreement dated Junuary 20, 1998. Reimbursable Items: All supplies,printing, maps, facsimile transmissions and reproduction would be charged at cost; all travel will be reimbursable at $0.31 per mile or at cost for other forms of travel. 1.2 TIMES OF PAYMENT 1.2.1 ENGINEER will submit monthly invoices for work performed under the terms of this agreement. Invoices are due and payable within 20 days receipt of invoice. Northeast Fort Worth Regional Mobility Study Page 3 Transportation Engineering Services Proposal . 97196000.AS1 � rG��i\91,S�J�p �Lyl1'So EXHIBIT C SERVICES BY THE CITY OF FORT WORTH 1.1 In general, the CLIENT and its representatives to their best of their efforts will render services as follows: 1.1.1 Provide full information as to the CLIENT's requirements for the PROJECT. 1.1.2 Assist the ENGINEER by placing at his disposal all available written data pertinent to previous operation, reports and any other data affecting the PROJECT. 1.1.3 Respond promptly in writing to requests by the ENGINEER for authorization to proceed with specific activities deemed desirable. 1.1.4 Examine documents submitted by the ENGINEER and render decisions pertaining thereto, promptly, to avoid unreasonable delay in the progress of the ENGINEER'S services. 1.1.5 Furnish information required of him as expeditiously as necessary for the orderly progress of the work. 1.2 The ENGINEER shall be entitled to rely upon the CLIENT's representative, who shall be identified in writing, regarding decisions to be made by CLIENT; further, all notices or information shall be deemed made when conveyed to the representative. 1.3 The services, information, and reports required by Paragraph 1.1 (above) 1.1.1 through 1.1.5 inclusive shall be furnished at the CLIENT's expense, and the ENGINEER shall be entitled to rely upon the accuracy and completeness thereof.
