AMENDMENT NO. 2
STATE OF TEXAS 3 CITY SECRETARY CONTRACT
COUNTY OF TARRANT 3
WHEREAS, the City of Fort Worth (City) and Deltatek Engineering,
(Engineer) made and entered into City Secretary Contract No. 23737, (the
Contract) which was authorized by the City Council by M&C C-16619 on the
17 day of February, 1998; and
WHEREAS, the Contract involves engineering services for the
following project:
Design Design and construction management of repair and repainting of
2MG Eastwood Elevated storage Tank, project No.P77-060770180150 .
WHEREAS, it has become necessary to execute Amendment No.2 to said
Contract to include an increased scope of work and revised maximum fee;
NOW THEREFORE, City and Engineer, acting herein by and through their
duly authorized representatives, enter into the following agreement which
amends the Contract:

Article I of the Contract is amended to include the additional
engineering services specified in a proposal letter dated December 2,
1998, a copy of which is attached hereto and incorporated herein. The
cost to City for the additional services to be performed by Engineer
total $28, 800. 00

Article II of the Contract is amended to provide for an increase in
the maximum fee to be paid to Engineer for all work and services
performed under the Contract, as amended, so that the total fee paid by
the City for all work and services shall not exceed the sum of
$159, 790. 00
3.
All other provisions of the Contract which are not expressly amended
herein shall remain in full force and effect .J

Dear Mr. Mir:
Deltatek Engineering authorized a sum of$24,000.00 to perform quality assurance during
the renovation of the referenced storage facility. The renovation was scheduled to begin
on August 10, 1998 and complete on December 10, 1998.
Due to various difficulties with A & J Industrial Coatings and lack of performance, this
project substantially completed on April 24, 1999. As a result, Deltatek Engineering
extended the inspection services to ensure that contractor complies with requirements of
the renovation documents and substantially complete this project. Therefore, total amount
of extended services resulted in a sum of$26,800.00. In addition, quality assurance

performed by electrical contractor employed by the City.

SUBJECT AMENDMENT NO. Y TO THE CONTRACT WITH DELTATEK ENGINEERING FOR THE
DESIGN AND CONSTRUCTION MANAGEMENT OF EASTWOOD ELEVATED
STORAGE TANK
RECOMMENDATION:
It is recommended that the Cit&ouncil authorize the City Manager to execute Amendment No. � to
City Secretary Contract (No. 2373) with Deltatek Engineering for the design and construction
management of the Eastwood Elevated Storage Tank, increasing the total contract cost by $28,800 to
$159,790.
DISCUSSION:
On February 7, 1998 (M&C C-16619), the City Council authorized the execution of an Engineering
Agreement with Deltatek Engineering for the preparation of specifications, construction management,
and construction inspection of the Eastwood Elevated Storage Tank. The contract scope included the
painting and repair of the existing tank. Amendment No. 1 will allow Deltatek Engineering to provide
additional construction management and inspection work necessary for the completion of the project.
The contractor has been charged liquidated damages for not completing the project on schedule.
Deltatek Engineering is in compliance with the City's M/WBE Ordinance by committing to an additional
14% M/WBE participation on this amendment.
FISCAL INFORMATION/CERTIFICATION:
The Finance Director certifies that funds are available in the current capital budget, as appropriated, of
the Commercial Paper-Water Fund.
