(No M&C Needed) COUNTY OF TARRANT S WHEREAS, the City of Fort Worth (City) and Carter & Burgess Inc. , (Engineer) made and entered into City Secretary Contract No. 22566, (the Contract) which was authorized by the City Council by M&C 15928 on the 4t' day of March 1997, and subsequently revised by seven previous amendments; and WHEREAS, the Contract involves engineering services for the following project: Engineering contract for the design of M-207R Drainage Area Sanitary Sewer System Evaluation and Improvements (Group 5, Contract 3) Part 2 . WHEREAS, it has become necessary to execute Amendment No. 8 to said Contract to include easement and property description work and revised maximum fee; NOW THEREFORE, City and Engineer, acting herein by and through their duly authorized representatives, enter into the following agreement, which amends the Contract: 1 . Article I of the Contract is amended to include the additional engineering services specified in a proposal letter dated the 20th day of April 2000, a copy of which is attached hereto and incorporated herein. The cost to City for the additional design services to be performed by Engineer total $7,250 . 00 2 . PS46-070460410270 The proposed amendment will allow Carter & Burgess Inc., to provide additional services to the project as requested by the City. Durina construction it was found that the existing sewer line was not inside the City easement in the Leonard property. Mr. Maddux, who represents the Leonard property, granted the City new easement on the new sewer lines on the condition that the City would abandon the old easement. It was, therefore, necessary to prepare legal descriptions for the new easement and the abandonment. Carter & Burgess Inc., has submitted a fee in the amount of $7,250.00 for the additional design work thereby increasing the contract fee from $527,195.00 to $534,445.00. I believe this fee is fair and reasonable for the additional services that are to be provided. It is recommend that the request be approved. Please authorize additional fee by your signatures on the attached contract amendment form. City of Fort Worth Department of Engineering 811 Lamar Street, Suite 310 Fort Worth, Texas 76102 Reference: Main 207R Drainage Area Sanitary Sewer Rehabilitation & Improvements (Group 5, Contract 3), Part 2 & Part 9 Dear Rakesh: We are providing this letter to request additional compensation for work beyond the engineering services outlined in the contract for Main 207R Drainage Area between Carter and Burgess and the City of Fort Worth. The additional services are due to revisions on the approved construction documents during the construction phase of the project. These revisions are described under Amendment No. 8 below. Amendment No. 8 Amendment No. 8 includes an increase in total contract amount of$7,250 in order to accommodate the following design changes: 1. Prepare a color exhibit showing the proposed easements, existing easements and easements to be abandoned for Sewer Main 207R. 2. Attend meetings with the City of Fort Worth to discuss easement exhibit. 3. Prepare 6 color copies of easement exhibit and deliver to the City of Fort Worth. 4. Prepare legal descriptions for easements through the Leonard's Property which will be abandoned.
