OF l t�\AS KNOW ALL BY THESE PRESENTS C0(fNTY OF TARRANT INTERLOCAL AGREEMENT This Agreement is made and entered into this k day of CvYI" 2000, by and between the County of Tarrant, acting herein by and through its governMg body, the Commissioners Court, hereinafter referred to as COUNTY, and the City of Fort Worth, acting herein by and through Mike Groomer, its duly authorized Assistant City Manager, hereinafter referred to as CITY, both of Tarrant County, State of Texas, witnesseth: \VIIFREAS, this :Agreement is made under the authority of Sections 791.001-791.029, Texas Government Code; and WHEREAS, each governing body, in performing governmental functions or in paying for the performance of governmental functions hereunder, shall make that performance of those payments from current revenues legally available to that party; and WHEREAS, each governing body finds that the subject of the Agreement is necessary for the benefit of the public and each has the legal authority to perform and to provide the governmental function or service which is the subject matter of this Agreement; and WHEREAS, each governing body finds that the performance of this Agreement is in the common interest of both parties and that the division of costs fairly compensates the performing party for the services or functions under this Agreement; and WHEREAS, each governing body agrees to share in the cost of the services described below. NOW THEREFORE, the COUNTY and CITY agree as follows: 1. The COUNTY agrees to provide the labor and equipment necessary to overlay the following streets: STREET LIMITS Cromwell Marine Creek Rd Boat Club Rd to Old Decatur Rd (Overlay) W. J. Boaz Rd Bowman Robert to Old Decatur Rd (Pulverized Overlay) Bowman Robert Rd Cromwell Marine Creek Rd to W. J. Boaz Rd(Pulverized Overlay) Marine Creek Parkway Cromwell Marine Creek Rd to Northwest College (Overlay) N.E. 29`x' St N. Main St to Decatur Rd (Pulverized Overlay) "'agley Roberts Rd Within Fort Worth Limits (Overlay) 2. The CITY agrees, at its sole option, to either deliver to COUNTY all of the materials necessary and required for the overlay of the roads, as described in paragraph 1 of the agreement, or to pay for the actual cost of the materials as incurred by the COUNTY. The value of the materials for the overlay of these six (6) streets shall not exceed 5363,512.10. 3. The CITY agrees to notify the COU'N'TY within thirty days of the completion of this project of any complaint the CITY has with the project. 4. Nothing in the performance of this Agreement shall impose any liability for claims against the COUNTY other than claims for which liability may be imposed by the Texas Tort Claims Act. 5. Nothing in the performance of this Agreement shall impose any liability for claims against the CITY other than claims for which liability may be imposed by the Texas`bort Claims Act. 6. The parties to the Agreement do not intend for any third party to obtain a right by virtue of this Agreement. 7. By entering into this Agreement, the parties do not intend to create any obligations express or implied other than those set out herein; further, this Agreement shall not create any rights in any party not a signatory hereto. s. This Agreement shall terminate on completion of the subject matter of this contract or on the conclusion of the COUNTY'S fiscal year, unless renewed for a period of one year in written notice signed by both parties. DISCUSSION: At the request of City staff, Tarrant County has agreed to enter into an Interlocal Agreement to overlay the six City streets listed below: STREET LIMITS Cromwell Marine Creek Road Boat Club Road to Old Decatur Road W. J. Boaz Road Bowman Robert to Old Decatur Road Bowman Robert Road Cromwell Marine Creek Road to W. J. Boaz Road Marine Creek Parkway Cromwell Marine Creek Road to Northwest College N.E. 29th Street North Main Street to Decatur Road Wagley Roberts Road Within Fort Worth city limits Under this agreement, Tarrant County will provide all the necessary labor and equipment to perform the work on these streets within the Fort Worth city limits. The City agrees, at its sole option, to either deliver to Tarrant County all of the materials required for the overlay of the above-named streets, or to pay for the actual cost of the materials as incurred by Tarrant County at a cost not to exceed $363,512.10.
