AMENDMENT No.2 TO CITY SECRETARY CONTRACT No. 45790 WHEREAS, the City of Fort Worth (CITY) and Goodwin Marshall, Inc. , (ENGINEER) made and entered into City Secretary Contract No. 45790, (the CONTRACT) which was authorized C-26848 on the 15th day of July, 2014 in the amount of $ $98, 500 . 00; and WHEREAS, the CONTRACT involves engineering services for the following project: Forest Park Improvements; and WHEREAS, the CONTRACT was subsequently revised by: Amendment Number 1 in the amount of $5, 700 . 00 which was administratively authorized on October 15, 2014; and WHEREAS, it has become necessary to execute Amendment No. 2 to the CONTRACT to include an increased scope of work and revised fee. NOW THEREFORE, CITY and ENGINEER, acting herein by and through their duly authorized representatives, enter into the following agreement, which amends the CONTRACT: 1 . Article I of the CONTRACT is amended to include the additional engineering services specified in a proposal dated February 11th, 2015, a copy of which is attached hereto and incorporated herein. The cost to City for the additional design services to be performed by Engineer totals $8,400.00. (See Attached Funding Breakdown Sheet, Page -3- ) 2 . Article II of the CONTRACT is amended to provide for an increase in � the fee to be paid to Engineer for all work and services performed under rn the Contract, as amended, so that the total fee paid by the City for all rrn work and services shall be an amount of $112, 600.00. 0 3. Based on our understanding,the following represents the scope of basic services that we believe necessary to successfully complete the additional program of work: SCOPE OF BASIC SERVICES 1. Unit 2: Colonial Parkway Improvements a. Colonial Parkway Design Changes - G&M will revise the demolition plan, specifications, and grading plans in accordance with the new design criteria required by the City of Fort Worth. G&M will incorporate these change into the project construction plans. G&M will submit this information to the city and provide technical support to facilitate acceptance. b. Flood Study Evaluation -There is an existing flood study for the floodplain area in the vicinity of the project. Due to the addition of the pedestrian bridge, G&M has been requested to evaluate the existing flood study and add the necessary cross sections to determine the impacts, if any, of the pedestrian bridge on the floodplain. This is necessary to insure that the addition of the pedestrian bridge will not impact the floodplain. G&M will prepare the evaluation as requested and submit this information to the city. Colonial Parkway Design Changes-G&M will perform the services as described for a lump sum fee of$1,300 payable upon submittal to the City of Fort Worth. b. Flood Study Evaluation-G&M will perform the services as described for a lump sum fee of$3,700 payable upon submittal to the City of Fort Worth. 2. Unit 3: Parking Lots a. Relocate and Regrade Two Parking Lots-G&M will perform the services as described for a lump sum fee of$3,400 payable upon submittal to the City of Fort Worth. DISCUSSION: The purpose of this Mayor and Council Communication (M&C) is to authorize the execution of an Engineering Agreement with Goodwin and Marshall, Inc., in the amount of$98,500.00 for engineering and design of park improvements in Forest Park. The proposed park improvements include a new trail and pedestrian bridge adjacent to Colonial Parkway, repaving Colonial Parkway, reconstruction of Park Place Drive and replacement of six existing parking lots along Colonial Parkway and Rogers Road. On May 1, 2012, (M&C G-17586) the City Council authorized the Parks and Community Services Department Fiscal Year 2012 Gas Related Revenue Project Expenditure Plan in the amount of $2,491,107.49 of which $501,924.16 was allocated for improvements at Forest Park. The amount represents the net prorated mineral lease bonus for Forest Park. The 2004 Capital Improvement Program (CIP) Proposition One: Street and Storm Sewer Improvements allocated the amount of$1,000,000.00 for park drainage and erosion control improvements. The available balance of$25,330.00 in this fund will be used towards additional drainage and erosion control improvements in Forest Park. The 1998 Capital Improvement Program (CIP) also allocated the amount of$1,800,000.00 for park road and parking improvements of which $309,732.00 remain and will be used for road and parking improvements in Forest Park. (City Secretary Contract No. 44577) to assess scoping needs and prioritization of improvements. This M&C will authorize Goodwin & Marshall, Inc., to proceed with final design and preparation of construction documents. M/WBE OFFICE - Goodwin and Marshall, Inc., is in compliance with the City's BDE Ordinance by committing to 20 percent SBE participation on this project. The City's SBE goal on this project is 17 percent. This project is located in COUNCIL DISTRICT 9, Mapsco 76N, 76P and 76T.
