TEXAS DEPARTMENT OF HOUSING AND COMMUNITY AFFAIRS AMENDMENT NUMBER 1 TO CONTRACT NUMBER. 61150002166 FY 2015 COMMUNITY SERVICES BLOCK GRANT PROGRAM(CFDA#93.569) This Amendment Number 1 to Community Services Block Grant Program Contract Number 61150002166 ("First Amendment") by and between The Texas Department of Housing and Community Affairs, a public and official agency of the State of Texas ("Department"), and City of Fort Worth, a political subdivision of the State of Texas ("Subrecipient"), hereinafter collectively referred to as "Parties", is executed to be effective on March 01,2015. RECITALS WHEREAS, the Department and Subrecipient, respectively, executed that Community Services Block Grant Program Contract Number.61150002166 to be effective on January 4,2015 ("Contract");and WHEREAS,the Parties desire to amend the Contract in the manner provided herein below. AGREEMENTS NOW THEREFORE, for valuable consideration, the receipt and sufficiency of which are hereby acknowledged,the Parties agree as follows: SECTION 1. Section 4.A Department Obligations,of this Contract is hereby amended to read as follows: "Section 4. A. Department Obligations. In consideration of Subrecipient's satisfactory performance of this Contract, Department shall reimburse the actual allowable costs incurred by Subrecipient during the Contract Term, and pre-award administrative expenses from January 1, 2015 in an amount up to $830,189.00 in accordance with the budget as approved by the Department and the terms of this Contract." SECTION 2. Section 35 B.Community Action Plan,of this Contract is hereby added to read as follows: "Section 35 B. Community Action Plan, To retain eligible entity status, Subrecipient will submit a community needs assessment to the Department on June 30,2015." SECTION 3. All of the remaining terms of the Contract shall be and remain in full force and effect as therein set forth and shall continue to govern except to the extent that said terms conflict with the terms of this First Amendment. In the event this First Amendment and the terms of the Contract are in conflict, this First Amendment shall M govern,unless it would make the Contract void by law. C-) M SECTION 4. SECTION 5. i� This First Amendment may be executed in several counterparts, each of which shall be deemed to be an a-b original copy, and all of which together shall constitute one agreement binding on Parties, notwithstanding that No all the Parties shall not have signed the same counterpart. chi SECTION 6. If any of the Parties returns a copy by facsimile machine or electronic transmission, the signing parry intends the copy of its authorized signature printed by the receiving machine or the electronic transmission to be its original signature. By signing this First Amendment, the Parties expressly understand and agree that its terms shall become a part of the Contract as if it were set forth word for word therein. SECTION 8. This First Amendment shall be binding upon the Parties hereto and their respective successors and assigns. SECTION 9. This First Amendment shall be effective and memorializes an effective date of March 01,2015. Authorize the acceptance of a grant and the execution of a contract with the Texas Department of Housing and Community Affairs in an amount up to $1,800,000.00 for the 2015 Community Services Block Grant program based upon the final award amount; 2. Adopt the attached interim appropriation ordinance increasing estimated receipts and appropriations in the Grants Fund in the amount of$300,000.00 for interim financing of this grant and providing for a reduction in the same amount if grant funds are not received; and 3. Adopt the attached final appropriation ordinance increasing estimated receipts and appropriations in the Grants Fund in the amount of$1,500,000.00, subject to execution of the Grant Agreement and receipt of the grant funds for a total amount not to exceed $1,800,000.00. DISCUSSION: On September 5, 2014, the Texas Department of Housing and Community Affairs notified grantees that the City's estimated grant allocation for the 2015 Community Services Block Grant (CSBG) program will be$1,468,721.00. Staff projects there may be an increase in funding later during 2015 resulting in a total estimated grant award of$1,800,000.00 for this CSBG program. At the time that the 2015 CSBG contracts are processed in January, the Texas Department of Housing and Community Affairs will make 25 percent of the funds available. CSBG provides programs and services to assist low-income persons with case management, emergency assistance, outreach and certification for energy assistance, information and referral and holiday assistance as well as services to provide clients with transportation to services for employment, educational, medical and other needs. The Community Action Partners in the Parks and Community Services Department serves as the designated Community Action Agency for all of Tarrant County, in accordance with federal law, and as such, administers CSBG-funded programs. Ten neighborhood Community Action Partners offices will be utilized to deliver the CSBG program services. Interim financing is necessary to provide transition from one grant funding period to the next. No matching funds are required from the City for the CSBG program. With adoption of the final appropriation ordinance, funds for appropriation through the remainder of the grant period will be available in the current operating budget, as appropriated, of the Grants Fund upon execution of the grant contract and receipt of the grant dollars. The department shall be responsible for identifying funding sources to cover expenses incurred under the interim financing in the event the grant funds are not received.
