Notice for Establishment of a RR Quiet Zone under 49 CFR 222.39(b)(1)and under Appendix B to Part 222 (1). This letter and the attachments are a Notice of Establishment (NOE) for the creation of a quiet zone under 49 CFR 222.39(b)(1) and Appendix B to Part 222 (1). As required by the Federal Railroad Administration under 49CFR 222.43, the following information is provided to you and other parties. EFFECTIVE DATE OF QUIET ZONE-222.43(d)(1)(i) Routine use of the locomotive horn at the crossings listed below shall cease effective 21 days from the date of execution by City Manager's Office. LIST OF HIGHWAY RAIL-GRADE CROSSINGS within the QUIET ZONE—222.43(d)(2)(i) All public highway-rail grade crossings to be included within the proposed quiet zone are: C= Crossing ID Street Name Location on Street Improvements e 795 430F Westport Parkway 5200 Block Median Barrier 795 349T Keller Haslet Road 4900 Block Channelization CL. The City of Fort Worth plans to implement a quiet zone at these crossings with the improvements C3 described for each crossing below. LU Mu Westport Parkway—Alternate Safety Measure (ASM) C.) Westport Parkway is an existing four-lane divided highway with concrete non-traversable LU medians. The crossing is equipped with flashing lights and gates, constant warning circuitry, and power-out indicators. The agency installed a traffic signal that is interconnected with the railroad crossing providing advance preemption. Although there are existing medians at this location, they do not comply with the length requirements to be considered as a Supplemental Safety Measure (SSM)_ The median on the west side of the crossing is over 200 feet in length and the median to the east of the crossing is approximately 35 feet in length due to a parallel street. As a result,this modified SSM has been treated as an ASM in establishment of the quiet zone. Printed on recycled paper 19641993•2011 Keller Haslet Road—(ASM) Keller Haslet Road is an existing two lane highway equipped with flashing lights and gates, constant warning circuitry and power-out indicators. The existing traffic signal is interconnected with the railroad equipment and provides advance preemption. The agency installed channelization at this crossing that is 100 feet in length to the west of the crossing and 35 feet on the east. This modified SSM has been treated as an ASM in the establishment of the quiet zone. REGULATORY BASIS FOR QUIET ZONE ESTABLISHMENT—222.43(d)(2)(ii) This quiet zone is being established under 49 CFR 222.39(b)(1) and Appendix B to Part 222 (1). The City of Fort Worth applied for approval of the quiet zone using modified SSMs that do not fully comply with the requirements for an SSM under Appendix A of the train horn rule and are therefore considered an ASM. The Public Authority Application (PAA) was submitted to the Federal Railroad Administration (FRA) and all railroads operating over the public grade crossings within the proposed quiet zone, the State agency responsible for grade crossing safety, and the State agency responsible for highway and road safety on June 19, 2013. FRA NOTICE OF APPROVAL—222.43(d)(2)(ii)(B) This quiet zone is being established under 49 CFR 222.39(b)(1) and Appendix B to Part 222 (1) and a copy of the FRA approval letter dated June 13, 2014 is provided in Attachment E. DIAGNOSTIC TEAM REVIEW-222.43(d)(2)(iii) A diagnostic team review is not required for this quiet zone under 222.25 or 222.27. However, the agency did invite State agency representatives, all affected railroads and the FRA to attend a diagnostic team review that was conducted on August 5, 2010. TIME PERIOD FOR HORN RESTRICTION -222.43(d)(2)(iv) The quiet zone shall restrict the routine sounding of locomotive homs 24 hours a day. EXISTING GRADE CROSSING INVENTORY FORMS-222.43(d)(2)(v) An accurate and complete grade crossing inventory form for each public, private, and pedestrian grade crossing within the quiet zone that reflects conditions existing at the crossings before quiet zone improvements were made are provided in Attachment C. The City proposed effectiveness rates for the alternative safety measures (ASMs) at the Keller Haslet Road and Westport Parkway crossings. • The Keller Haslet Road crossing will consist of 100 feet of channelization device west of the crossing and 35 feet of channelization device east of the crossing. The City suggested an effectiveness rate of 0.63. FRA determined that a slightly lower effectiveness rate of 0.59 is more appropriate, due to the type of safety improvement being proposed and the length of the improvement. • The Westport Parkway crossing consists of a 295-foot non-traversable median on the west side of the crossing and a 35-foot non-traversable median on the east side of the crossing. The City suggested an effectiveness rate of 0,63, which is consistent with the information provided. Pursuant to 49 CFR § 222.39(b)(4), FRA approves the application submitted by the City. Implementation of the ASMs, as described above, will result in a Quiet Zone Risk Index of 31,085, which is below the Risk Index With Horns (the risk that would be present if the horns were still sounding) of 49,037.
