HomeMy WebLinkAboutContract 27966-A3 AMENDMENT NO. 3 STATE OF TEXAS S CITY SECRETARY CONTRACT NO o21L�-A3 (MSC Required) COUNTY OF TARRANT 8 WHEREAS, the City of Fort Worth (City) and Teague Nall and Perkins, Inc. , (Engineer) made and entered into City Secretary Contract No. 27966, (the Contract) which was authorized by the City Council by MSC C-19206 on the 27th day of August, 2002 and subsequently revised by two previous amendments; and WHEREAS, the Contract involves engineering services for the following project: Sanitary Sewer Rehabilitation Contract LII (52) . WHEREAS, it has become necessary to execute Amendment No. 3 to said Contract to include an increased scope of work and revised maximum fee; NOW THEREFORE, City and Engineer, acting herein by and through their duly authorized representatives, enter into the following agreement which amends the Contract: 1. Article I, of the Contract is amended to include the additional engineering services specified in MSC C-27966, adopted by the City Council on the 15th day of December 2009, and further amplified in a proposal letter dated August 12, 2009, copies of which are both attached hereto and incorporated herein. The cost to City for the additional services to be performed by Engineer total $108,539.00. 2. Article II, of the Contract is amended to provide for an increase in the maximum fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall not exceed the sum of $424,689.00. Authorize the transfer of$116,539.00 from the Water and Sewer Operating Fund to the Sewer Capital Projects Fund; 2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Sewer Capital Projects Fund in the amount of$116,539.00 from available funds; and 3. Authorize the City Manager to execute Amendment No. 3 in the amount of$108,539.00 to City Secretary Contract No. 27966 with Teague Nall and Perkins, Inc., for additional engineering services for Sanitary Sewer Rehabilitation Contract LII, thereby increasing the contract amount to $424,689.00. DISCUSSION: On August 27, 2002, (M&C C-19206) the City Council authorized the City Manager to execute an Engineering Agreement with Teague Nall and Perkins, Inc., in the amount of$290,300.00 for Sanitary Sewer Rehabilitation Contract LII. The contract was subsequently revised by two amendments totaling $25,850.00 that are further described as follows: Amendment No. 1 in the amount of $21,750.00 administratively approved by the City Manager on December 23, 2003, provided for an hydraulic and hydrologic study of Marine Creek for a sanitary sewer aerial crossing and the preparation of additional right-of-entry and easement documents on the project; and Amendment No. 2 in the amount of $4,100.00 and administratively approved by the City Manager on December 19, 2005, provided for revisions to the alignment of sewer lateral L-1981 as requested by staff and the preparation of a construction easement for the line. Amendment No. 3 will provide compensation for the following: The preparation of additional permanent and temporary construction easements; The preparation of additional permits needed from Texas Department of Transportation and Tarrant Regional Water District; Subsurface utility investigation; Geotechnical investigation; and The preparation of plans and specifications for an additional 3,300 feet of sanitary sewer mains. Teague Nall and Perkins, Inc., proposes to provide the necessary additional design and survey services for a fee of$108,539.00. Staff considers this fee to be fair and reasonable for the scope of services proposed. Project Manager Fort Worth Water Department 1000 Throckmorton Street Fort Worth, Texas 76102 RE: Request for Amendment No. 3 to Sanitary Sewer Rehab Contract LII (M-39 Sanitary Sewer Replacement) Dear Rakesh: TNP is pleased to submit a fee proposal for the M-39 Sanitary Sewer Replacement project. We prepared this proposal based on the Option B alignment alternative, as well as our own site visit and plan research. The project consists of the construction of approximately 3000 feet of sanitary sewer main, ranging in size from 18" — 36% located in and around the Highway 287 and Lancaster Avenue interchange. The main will cross Lancaster Avenue (twice), Highway 287, and various highway ramps. Pipe depths are anticipated to be on the order of 30 to 40 feet, maximum. The following assumptions were used in developing engineering and surveying fees for the project: Engineering Design • Includes coordination with TxDOT, Ranch Style Beans plant and other property owners, • Traffic Control Plans will be developed for Lancaster, 287 and affected ramps, • Design will meet TxDOT's Utility Accommodation Rules. Surveying • Existing right-of-way and property lines will be determined, • Surveying for this project is not continuous because of numerous highway crossings and elevation differences—will require many setups, Tree survey needed just east of Ranch Style Beans. Easements • One (1) permanent and two (2)temporary easements are anticipated, • Permanent and temporary easement needed from Ranch Style Beans, • Temporary easement likely needed from property north of Lancaster/west of 287. We are committing $20,500 to them on this project which equates to 18.9% of the professional services fee. Alphagraphics, also a local M/WBE firm, will provide printing services in the amount of$3,000 or 2.8% of the project.
