FIRST AMENDMENT TO
CITY SECRETARY CONTRACT NO. 45782
THIS FIRST AMENDMENT to City Secretary Contract No. 45782 is entered into by and
between the City of Fort Worth ("City"), a home-rule municipality in the State of Texas,
acting through Fernando Costa, its duly authorized Assistant City Manager, and
Industrial Hygiene and Safety Technology, Inc. ("Contractor"), acting through Derrick K.
Johnson, its duly authorized Vice-President of Operations.
WHEREAS, the City and Industrial Hygiene and Safety Technology, Inc. have entered
into that certain agreement identified as City Secretary Contract No. 45782 (also the
"Contract") commencing on July 25, 2014 for asbestos, mold, and industrial hygiene
consulting services as authorized by Mayor and Council Communication C-26842; and
WHEREAS, the contract was for an initial term of one year and that contract provides
for the extension of the term of the agreement for up to three additional periods of one
year; and
WHEREAS, the contract provides for compensation not exceed one hundred thirty
thousand dollars ($130,000.00) for any one-year term; and
WHEREAS, Administrative Change Order No. 1 provides for a thirty-two thousand five
hundred dollar ($32,500.00) increase in the contract amount for the original contract
term; and
WHEREAS, the parties wish to increase the contract amount for the original contract
term by an additional one hundred one thousand five hundred dollars ($101,500.00) to
provide for additional asbestos abatement consulting services at Meacham International
Airport General Terminal Building beyond the original scope of the contract, and
sufficient funds have been appropriated as approved by Mayor and Council
Communication C-27366; and
WHEREAS, the parties agree that all other conditions, terms, and pricing shall remain
the same as stated in City Secretary Contract No. 45782;
NOW, THEREFORE, for and in consideration of the mutual covenants contained herein,
and other good and valuable consideration, the receipt and sufficiency of which are
hereby acknowledged and confessed, the parties hereto agree as follows:

1. Compensation Not to Exceed Amount:
Compensation shall not exceed two hundred sixty-four thousand dollars ($264,000.00)
for the original annual term of City Secretary Contract number 45782, billable according
to the compensation schedule of City Secretary Contract number 45782 and subject to
all other terms and conditions as stated in City Secretary Contract number 45782.
2. Miscellaneous:
All other definitions, terms, and conditions of City Secretary Contract number 45782
shall remain unchanged except as expressly set forth herein.
IN WITNESS THEREOF, the parties have executed this contract in triplicate in Fort
Worth, Texas, on the dates written below.

SUBJECT:
Authorize Execution of Amendment No. 1 to City Secretary Contract No. 45782 with Industrial Hygiene and
Safety Technology, Inc., in the Amount of$101,500.00 for Providing Continued Asbestos, Mold and
Industrial Hygiene Professional Services at the General Terminal Building at Meacham International Airport,
Thereby Revising the Total Contract Amount to$264,000.00 and Adopt Supplemental Appropriation and
Appropriation Ordinances (COUNCIL DISTRICT 2)
RECOMMENDATION:
It is recommended that the City Council:
1. Adopt the attached supplemental appropriation ordinance increasing appropriations in the Environmental
Protection Operating Fund in the amount of$101,500.00 and decreasing the unassigned fund balance by the
same amount;
2. Authorize the transfer of$101,500.00 from the Environmental Protection Operating Fund to the
Environmental Protection Project Fund;
3. Adopt the attached appropriation ordinance increasing estimated receipts and supplemental appropriations
in the Environmental Protection Project Fund in the amount of$101,500.00; and
4. Authorize the execution of Amendment No. I to City Secretary Contract No. 45782 with Industrial
Hygiene and Safety Technology, Inc., in the amount of$101,500.00 for providing continued asbestos, mold
and industrial hygiene professional services at the General Terminal Building at Meacham International
Airport, thereby revising the total contract amount to$264,000.00.
DISCUSSION:
The Amendment recommended by this M&C is for continued professional asbestos abatement consultant
services for work required by Federal and State law to provide air monitoring during the removal of
additional asbestos—containing materials discovered during the interior demolition of the Meacham Terminal
Building, beyond what was anticipated when the asbestos scope of services was developed.

inclusive of the amendment to increase the contract value.
The project is physically located in COUNCIL DISTRICT 2,but it will serve Fort Worth residents in ALL
DISTRICTS.
FISCAL INFORMATION:
The Financial Management Services Director certifies that upon approval of the above recommendations and
adoption of the attached supplemental appropriation and appropriation ordinances,funds will be available in
the current capital budget, as appropriated,of the Environmental Management Project Fund.
