FIRST RENEWAL AND AMENDMENT OF
CITY SCRETARY CONTRACT NO. 43353,A MANAGEMENT AGREEMENT
FOR MCLELAND TENNIS CENTER
THIS FIRST RENEWAL AND AMENDMENT OF CITY SECRETARY CONTRACT
NUMBER 43353, as amended, ("First Renewal and Amendment") is made and entered into by and
between the City of Fort Worth, Texas, a home-rule municipal corporation of the State of Texas("City"),
acting by and through its duly authorized Assistant City Manager, and the 2tennis.net, LLC, a Texas
limited liability company(the"Contractor"), acting by and through its duly authorized President.
WHEREAS, the City owns certain dedicated parkland known as Rosemont Park, located at 1400
West Seminary Drive,Fort Worth, Texas 761.15 (the "Park");
WHEREAS, a portion of the Park has been set aside for the operation of a municipal tennis
facility known as the McLeland Tennis Center, which is located at 1600 West Seminary Drive, Fort
Worth, Texas 76115 (the"Center");
WHEREAS, on or about June 29, 2012, the City and the Contractor entered into an agreement
for the Contractor to manage the Center, the same being City Secretary Contract("CSC")Number 43353
("Agreement");
WHEREAS,the primary term of the Agreement is for three(3) calendar years, beginning on July
1, 2012 and expiring on June 30,2015;
WHEREAS, the Agreement provides that the term may be renewed for two successive two-year
periods;
WHEREAS, the parties desire to amend the renewal provision of this Agreement to reduce the
renewal term from two successive two-year terms to two successive one-year terms;
WHEREAS, the parties desire to exercise the amended renewal option of one year to continue
this relationship;
NOW, THEREFORE, in consideration of Ten Dollars and No Cent ($10.00) to be paid to the
City by the Contractor,the sufficiency of which is hereby acknowledged, the City and Contractor agree to
amend and renew the Agreement as follows:
I.
AMENDMENT
1. Section 2.2 is of the Agreement is hereby amended in its entirety to read as follows:
"2.1 Unless previously terminated,the Agreement may be renewed by written
mutual consent of the parties for one (1) successive one-year period under the
same terms and conditions of this Agreement."
H.
RENEWAL
1. The City and Contractor hereby agree to renew and extend the Agreement for one year,
effective beginning on July 1, 2015 and ending off"JUffe-30;'"'2"0167-""'""'

MISCELLANEOUS
1. All terms of this First Renewal and Amendment that are capitalized but not defined shall
have the meanings assigned to them in the Agreement.
2. All terms and conditions of the Agreement that are not expressly amended pursuant to the
First Renewal and Amendment shall remain in full force and effect.
