For Synrgy 360S, T, XS, XM, HD Elite Half Rack/Short Base units and all
accompanying Strength Equipment
City of Fort Worth "City"pursuant to Purchase Order No. PO-15-00087877-1 purchased certain pieces
of Life Fitness and/or Hammer Strength strength training equipment(the "Order").
Life Fitness recommends that all strength training equipment be secured to the floor in order to
prevent tipping, rocking or displacement which might occur in the event of unanticipated use of the
equipment.Life Fitness requires that certain strength training equipment(specifically the Synrgy 3605, T,XS,
XM, the HD Elite Half Rack/Short Base unit and other products to be used for body weight strap training) be
secured to the floor. City understands that securing the equipment to the floor will result in holes in, and
alterations to, the flooring and subflooring materials. Life Fitness will provide services to secure the
equipment to the floor under the following conditions:
(a)City has determined the proper placement of the equipment to be secured;
(b)City has informed Life Fitness of the placement of utility and service lines in the floor;
(c) City has informed Life Fitness of the substance of the flooring; and
(d)City has obtained any and all consents to the drilling of hole in the flooring and subflooring.
City agrees, to the extent permitted by law, that it will be responsible for, and will
indemnify Life Fitness fi•om, claims of injuries or losses (including, (i) damage to property, (ii) any
personal injuries or(iii) any economic losses (including lost profits or other incidental damages))which
may occur arising from any inaccuracies in the provision of information in(a)through(d)above.
City acknowledges that Life Fitness has made its services available to secure the Order's other
strength training equipment to the floor.
Life Fitness Service personnel will be available, at a standard hourly rate, to assist City in the
event that you require service post installation.
By signing below,you represent that you have all power and authority to enter into this agreement
on behalf of City of Fort Worth.
