STATE OF TEXAS § § KNOWN ALL BY THESE PRESENTS: COUNTY OF TARRANT § SECOND AMENDMENT TO CITY SECRETARY CONTRACT NO. 45084 THIS SECOND AMENDMENT to City Secretary Contract No. 45084 is entered into by and between the City of Fort Worth, a home-rule municipal corporation situated in Tarrant County, Texas ("Fort Worth"), acting through Fernando Costa, its duly authorized Assistant City Manager, and The City of Arlington, located in Tarrant County, Texas ("Participant"), acting through James F. Parajon, its duly authorized Deputy City Manager. WHEREAS, Fort Worth and the Participant have entered into that certain agreement identified as City Secretary Contract No. 45084 (also the "Agreement") for fiscal year 2014 (October 1, 2013 through September 30, 2014) whereby Fort Worth will purchase the services of a waste disposal/recycling firm or firms and will administer a household hazardous waste collection program as authorized by Mayor and Council Communication C-26421; and WHEREAS, that Agreement was for an initial term of one year and that Agreement provides for the extension of the term for up to three additional periods of one year each; and WHEREAS, City Secretary Contract No. 45084 A-1 extended the contract term from October 1, 2014 through September 30, 2015; and WHEREAS, the parties wish to extend the term of the initial Agreement for an additional year commencing on October 1, 2015 through September 30, 2016; and WHEREAS, the parties agree that all other conditions, terms, and pricing shall remain the same as stated in City Secretary Contract No. 45084; NOW, THEREFORE, for and in consideration of the mutual covenants contained herein, and other good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged and confessed, the parties hereto agree as follows: 1. Extended term of agreement: City Secretary Contract number 45084 is extended to include the term beginning on October 1, 2015 and ending on September 30, 2016. Anticipated Holiday Closures: During the extended term of the agreement, the Environmental Collection Center (ECC) will be closed on the following holidays that are observed on days the ECC would otherwise be open to the public: Thanksgiving holiday, Thursday and Friday, November 26-27, 2015 Christmas holiday, Friday, December 25, 2015 New Year's Day holiday, Friday, January 1, 2016 3. Miscellaneous: All definitions, terms, conditions, and prices, as well as the rights and obligations of the parties as set forth in City Secretary Contract number 45084 shall remain unchanged except as expressly set forth herein. Bashor p o°�°�IIOO°00��� Assistant City Attornto ° ° d �d o 0 0 7'd 00 0*�� AT d$ °o° °o° a' Attes Xa�n��X44.oa _ ary J. kqxai C City Secretary.,„tra �AarySup ty Secretaryct Atara� q -1(�` f _._ LOFFICIALCORDSecond Amendme1��At ntract#45084 TARYHousehold Hazardous Waste Program-The City of Arlington ,TX t Resolution No. 15-227 A resolution authorizing the execution of a Second Amendment to the Interlocal Agreement with the City of Fort Worth relative to participation in the Environmental Collection Center Household Hazardous Waste Collection Program WHEREAS, on October 15, 2013, by Resolution No. 13-259, the City Council authorized the execution of an interlocal agreement with the City of Fort Worth, relative to participation in the Environmental Collection Center Household Hazardous Waste Collection Program; and WHEREAS, on September 16, 2014, by Resolution No. 14-229, the City Council authorized the execution of an amendment to the interlocal agreement with the City of Fort Worth relative to extending the interlocal agreement through FY 2015; and WHEREAS, the initial term of the agreement was for one year with a provision for extension of the term for up to three additional one-year periods; and WHEREAS, the parties wish to extend the term of the agreement through FY 2016; NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ARLINGTON, TEXAS: I. That the City Manager or his designee is hereby authorized to execute a Second Amendment to the Interlocal Agreement with the City of Fort Worth relative to participation in the Environmental Collection Center Household Hazardous Waste Collection Program. The amendment extends the Interlocal Agreement for participation in the program through FY 2016. All other conditions, terms and pricing shall remain the same. The City anticipates approximately 5,200 uses by Arlington residents during FY 2016, for a total estimated amount of $244,400. Funding is available in Storm Water Administration Account No. 300101-61002 and subject to FY 2016 budget approval. IT. A substantial copy of the Second Amendment is attached hereto and incorporated herein for all intents and purposes.
