WHEREAS, The City of Fort Worth and CMJ Engineering, Inc. (Engineer) made and entered into City
Secretary Contract No. 46085 (The Contract)which was authorized by the City Council by M&C C-27013,
the 23th day of September, 2014; and
WHEREAS, further amendment is necessary to reimburse the Engineer as part of the material testing
services agreement for additional material testing services for continuation of construction.
NOW THEREFORE, City and Engineer, acting herein by and through their duly authorized
representatives, enter into the following agreement which amends the Contract:
1.
Article 1.1, SECTION I —SERVICES OF THE ENGINEER, the following paragraphs are added to read as
follows:
Provide additional material testing services for construction. The cost of this additional service is
$25,000.00. The scope of services is described more fully in the CMJ Engineering letter dated
September 21, 2015, subject: Budget Increase, Construction Materials Testing Services for Will
Rogers Memorial Center, Cattle Barn 2 Renovations, Fort Worth, Texas which is attached hereto
as Attachment"A"and made a part of this Agreement."
2.
Paragraph 1 of SECTION V-COMPENSATION TO ENGINEER, is amended as follows:
"The total compensation for all of the assignments to be performed by Engineer as described in
Compensation hereof shall be a Not to Exceed fee of$100,000.
3.
All other provisions of this Contract which are not expressly amended herein shall remain in full force and
effect.
