HomeMy WebLinkAboutContract 31045-A4 %g�� I�i' C`Yli V "I"', ' ':g `,U",v"T IRA MOM 6 AMENDMENT No. 4 NQ� L TO CITY SECRETARY CONTRACT WHEREAS, the City of Fort Worth (CITY) and Jacobs Engineering Group Inc. , (ENGINEER) made and entered into City Secretary Contract No. 31045, (the CONTRACT) which was authorized by M&C C-20374 on the 2nd day of November, 2004 in the amount of $ 96, 122 . 56; and WHEREAS, the CONTRACT was subsequently revised by: Amendment Number 1 in the amount of $216, 466 . 00 which was authorized [by M&C # C-23601 on June 16, 2009, Amendment Number 2 in the amount of $102, 851 . 00 which was authorized by M&C # C-24870 on April 19, 2011, Amendment #3 in the amount of $49, 725 . 00 which was authorized by Administrative Action on February 21, 2014; and WHEREAS, the CONTRACT involves engineering services for the following project: Trinity Boulevard Culvert Improvements at Valley View Branch, Project No. 00100; and WHEREAS, it has become necessary to execute Amendment No. 4 to the CONTRACT to include an increased scope of work and revised fee . NOW THEREFORE, CITY and ENGINEER, acting herein by and through their duly authorized representatives, enter into the following agreement, which amends the CONTRACT: 1 . Article I of the CONTRACT is amended to include the additional engineering services specified in a proposal dated December 14, 2014, a of which is attached hereto and incorporated herein. The cost to City for the additional design services to be performed by Engineer totals $49, 710. 00. (See Attached Funding Breakdown Sheet, Page -3-) 2 . Article II of the CONTRACT is amended to provide for an increase in the fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall be an amount of $515, 074. 56. 3 . Services on the original contract and subsequent 3 Amendments also included bidding and construction services, permitting and ROW/easement assistance. In the process of performing the work, several additional scope items have been identified which are addressed in this amendment. SECTION II — BASIC SCOPE OF SERVICES Item 1 — Preparation of Additional Permitting Documents Background The original contract stated that the required permitting for the Nationwide Permit(NWP) 14 will be accomplished as additional services on an hourly basis. Ten hours of service were included in the scope and fee for the initial coordination with the USACE to determine the NWP 14 applicability. Proposed Work After the initial impacts to the Waters of the US for Valley View Branch were determined, Jacobs begin coordination with the USACE to determine the applicability for using the NWP 14 to permit the impacts to the creek. Initially, the USACE indicated that the NWP 14 would be applicable. As the project developed and more excavation in the creek was needed to contain the 100-year flood within the project limits, the USACE started to indicate that the limits of impact were beginning to indicate the need for an Individual Permit under Section 404. An individual permit can take over a year to obtain and requires extensive coordination and approval from several state and federal agencies. Instead of the Individual Permit, Jacobs was able to convince the USACE that the impacts could be broken into two types of permits and forego the Individual Permit application and processing time. The accepted approach by the USACE was to accept one NWP 14 application for the impacts to the bridge and another Letter of Permission 2 permit application for the impacts due to the excavation in the creek downstream of the bridge. Under this approach, Jacobs prepared an extensive application package for the NWP 14 section of the project and a separate LOP 2 application package for the downstream portion of the project. Each of these packages included separate detailed project descriptions, exhibits and quantification of impacts. As part of the NWP 14 process Jacobs prepared a conceptual mitigation plan report that was included with the Pre-Construction Notice (PCN)application. Per initial discussions, it was assumed the City would purchase mitigation banking credits which would not require such a plan. However, as the project progressed and it was determined that there was an opportunity for the City to receive some mitigation credit for the stream modification activities (i.e. removal of culverted crossing resulting in approx. 75 linear feet of stream channel), then it was necessary to include the mitigation plan report with the PCN. The benefits to the city for Jacobs convincing the USACE to allow the two-permit approach was that an expensive and time-consuming Individual Permit process was avoided. If an Individual Permit process would have been required by the USACE, the city most likely would have been required to provide mitigation for the whole project. With the two-permit approach, only mitigation for the upper portion was required. This mitigation was accomplished through a fee in lieu of on-the-ground mitigation. Jacobs convinced the USACE that no mitigation was required under the bridge. The USACE agreed with Jacobs' assessment that the stream under the bridge would re-establish itself over time. The lower portion of the project was excluded from any mitigation based on the conditions of the Letter of Permission. An Individual Permit can take between 10 to 18 months to obtain. In addition, there is a public notification process involved and individual acceptance is required from four federal and state agencies. The Nationwide Permit and Letter of Permission process used on the project did not require any of these time-consuming processes. Deliverables The following deliverables were required for this task: 1. Nationwide Permit 14 application package with project description, project impact exhibits, impact calculations and proposed mitigation credit concept. 2. Letter of Permission 2 application package with project description, project impact exhibits, impact calculations and mitigation concept. 3. A mitigation concept plan was prepared for the City of Fort Worth to perform the mitigation on the project site. 4. Project coordination with the USACE to take both the applications to final approval with the USACE. Item 2— Revise Water and Sewer Plan Sheets Background The improvements to Trinity Blvd. required the adjustment and relocation of sewer lines adjacent to the project. The proposed utility revisions were presented to the City during reviews of the construction plans at the 60%, 90% and 100% review stages. Comments from the City were incorporated into each stage of the review. After all comments were accepted by the City, the project was advertised for bidding. Proposed Work As the cover sheet for the bid set was being routed for signature, the water department asked that the sewer sheets be revised to show the sewer line adjustments on the Bell Helicopter property instead of traversing a more direct route to an existing manhole. Jacobs removed all sewer line relocation shown on the final set of plans. In place of the alignment for the sewer shown on the final plans, the sewer was relocated to an upstream portion of an existing line. This required creating new plan / profile sheets, relocating a new manhole on an existing line and structural changes to a proposed hydraulic drop structure in the adjacent creek. The revised sewer line was required to traverse under and through the proposed drop structure. This required structural design modifications to the structure to accommodate the sewer line. Since the project was out for bidding at the time of the revisions, additional Jacobs' staff were deployed to the project in order to accommodate the bidding schedule. Deliverables The deliverables for this item included 7 revised plan sheets and 9 new sheets for the re-aligned sewer system.
