AMENDMENT No. 1
' TO CITY SECRETARY CONTRACT No. 45841
WHEREAS, the City of Fort Worth (CITY) and Tank Industry
Consultants, Inc, (ENGINEER) made and entered into City Secretary
Contract No. 45841, (the CONTRACT) which was authorized by M&C C-26879 on
the 22nd day of July, 2014 in the amount of $148, 500 . 00 ; and
WHEREAS, the CONTRACT involves engineering services for the
following project :
Timberline Elevated Storage Tank Rehabilitation Project; and
WHEREAS, it has become necessary to execute Amendment No. 1 to the
CONTRACT to include an increased scope of work and revised fee .
NOW THEREFORE, CITY and ENGINEER, acting herein by and through their
duly authorized representatives, enter into the following agreement,
which amends the CONTRACT:

Article I of the CONTRACT is amended to include the additional
engineering services specified in a proposal dated September 25, 2015, a
copy of which is attached hereto and incorporated herein. The cost to
City for the additional services to be performed by Engineer totals
$28, 938 .21 .
2 .
Article II of the CONTRACT is amended to provide for an increase in
the fee to be paid to Engineer for all work and services performed under
the Contract, as amended, so that the total fee paid by the City for all
work and services shall be an amount of $177, 438.21 .
3 .
All other provisions of the Contract, which are not expressly
amended herein, shall remain in full force and effect .

The contractor was authorized to proceed ou February 23" 2O|5. Rain,cold
temperatures and wind io March,April and May delayed pnnyreso of the work
resultiu-in late completion and unanticipated ovmdiouc work for 7IC`x ouoito
observer. Substantial Completion was required by June 23,2D}4,but the work
was not completed and the tank disinfected until August 26,20|5.
In May 28{5`TIC estimated costs for onuite Project Representation before TIC
had had uo opportunity to evaluate the actual condition of the tank. The Con-
tractor vvodkcdloogorhour»uu6onSuturduys,4nJoeurth:eodnmx&ivmnper-
ooissiootuworkouSon6uyouz000D/lete the project. These extra hours and
days required TIC's observer to be on site longer than estimated or budgeted.
TIC has invoiced $157`581.11 uo date and anticipates invoicing unadditional
$]9,&57.l0 before the First Ann ivemo'yEvaluation. The amooDttobe invoiced

includes a few hours of contract administration for completing minority subcontracting reports and the ma-
jority of our subcontractors' invoiced amounts.
Please approve additional funding of$28,938.21 for Engineering Services on this project.
