I� i I CONTRACT i for the LOOSELEAF SUPPLEMENT SERVICE for the CODE OF THE CITY OF FORT WORTH, TEXAS by the MUNICIPAL CODE CORPORATION Tallahassee, Florida i iI I� i i i i This agreement, made and entered into this I day of 1972, by and between the MUNICIPAL ! CODE CORPORATI , a corporation duly organized and existing under the laws of the State of Florida, hereinafter referred to as the Corporation and the CITY OF FORT WORTH, a municipal corporation s lin the State of Texas, hereinafter referred to as the municipality. �I WITNESSETH: That upon the terms and conditions set forth in this contract, the Corporation and the municipality hereby jagree as follows: I. The Corporation hereby agrees to maintain the Code i of the municipality up-to-date by means of publishing Looseleaf ? Supplements, containing the new ordinances of a general and permanent nature passed subsequent thereto. II. In the performance of this agreement, it is requested that the ordinances be forwarded to the Corporation i ! following official enactment by the municipality. The Corporation I will publish the Looseleaf Supplements as often as the munici- Ilpality desires. The time required for completion and shipment of the Supplements from the date of the schedule established, will be thirty (30) to forty-five (45) days. There shall be no penalties or additional charges incurred on the part of the municipality for more or less frequent publication dates. itIII. The Corporation will study the new ordinances in iicon,junction with the existing provisions of the Code for the {purpose of determining if any provisions of the basic Code are 1 repealed, amended or superseded. The page or pages of the Code, ;containing provisions that are specifically repealed or amended i iby ordinance shall be reprinted or printed to remove such i repealed or amended provisions and insert the new ordinances. i i ! E Appropriate amendment or other editorial notes will be re ared P P and appended to the new sections, explaining the effect of the knew ordinance on the repealed or amended provisions, as necessary. History notes will follow each new section of the Code when inserted, which notes will include references to the new ordinances from which the section is derived. IV. The Corporation will prepare a Comparative Table Ilisting the ordinances included in each Supplement, and setting 8 out the location thereof. This Table will be inserted preceding the Index. V. The Corporation will make recommendations as to , style and format, which recommendations can be incorporated into I ;'the Supplements as pages affected by ordinance are printed or Jreprinted, if desired by the municipality. II VI. The Corporation offers to prepare editorially a complete new Index for the entire Code after preparation of the `first Supplement published under this contract. The cost for 1preparing a new Index will be at the rate specified in Paragraph iIVIII for other pages to be printed and added to said Code. In 11future Supplements when the inclusion of new material necessitates changes in the Index, appropriate entries will be prepared and ;printed, or when necessary pages of the Index will be printed I for reprinted to include the new entries. VII. Each Supplement will contain a page of instructions i ; for the removal of the old pages and the insertion of the new ages. VIII. The Corporation will prepare the ordinances 'editorially and print four hundred (400) copies of each Supplement for the sum of TWELVE DOLLARS AND FIFTY CENTS ($12.50) per page, including blank pages. IX. For the purpose of this agreement, a page is hereby defined as the area on one (1) side of a sheet of paper. A sheet ;contains two (2) pages. F `I i' - 3 - i 6 it X. In the event the manuscript for the Supplements Ito the Code shall contain tables, drawings, designs, Algebra formulae and the like for which either engraved cuts or other ethods of reproduction other than straight linotype operation are required, the cost of such engravings or tabular matter will be additional to the costs as provided in Paragraph VIII above. XI. All money due the Corporation for the publication r f Looseleaf Supplements will be due and payable upon shipment If each Supplement to the municipality and shall be payable rithin thirty (30) days after the date the municipality is invoiced for the same by the Corporation, without interest. MAILING AND STORING N OF SUPPLEMENTS ALTERNATE A• MI. Upon publication of the Supplements, all copies hall be mailed to the City Hall, Fort Worth, Texas, in care of !the City Clerk, or other designated officer. All charges shall e paid by the City. II. It shall be the duty of the City to distribute Ithe copies of the Supplements and collect any charges required by the City. I LTERNATE B: I. The Corporation will ship to the City as many of !the printed copies of the Supplements as requested, for use by ,the City of Fort Worth and for the undistributed copies of the jlCode. II, i i 1 II. The Corporation will mail copies of each Supplement to those persons to whom the City Code has been distributed. ' The names and addresses of such persons shall be furnished to the Corporation by the City. III. The cost for the mailing of the Supplements shall be fifty cents (0.50) per mailing, plus the cost of postage. , The Corporation shall include the cost of mailing as provided lin this paragraph on the statement of charges for each Supplement, as provided in the contract. i C. OTHER GENERAL PROVISIONS: i I. It shall be the duty of the City to exercise its election of either Alternate A or Alternate B upon return of the contract to the Corporation. The codification and the supple- ments where done by Michie City Publishing Company, Charlottesville, Virginia. The 1968 supplements cost $13.50 per page. In 1969 Municipal Code Corpora- tion of Tallahasse, Florida, presented the City a proposed contract agreeing to bring the Code up to date and publish the supplements for the approximate 400 City Codes originally published for the sum of $12.50 per page. This was the best proposal made to us at that time, but due to insufficient budgeted funds and personnel to copy the ordinances, the City did not follow through on the proposal presented. Municipal Code Corporation has agreed to abide by its 1969 proposal to bring the Code up to date for $12.50 per page for the approximate 400 Codes origi- nally published. It. is estimated that to bring the Code up to date will cause revisions and/or additions amounting to approximately 500 pages at a cost of $6,250. Funds are available in current budgets of the City Secretary-Treasurer Office. Recommendation It is recommended that the City Manager be authorized to contract with Municipal Code Corporation and authority be granted to reserve $7,000 out of the current budget to pay for the City Code supplements.
