CONTRACT AMENDMENT
THE STATE OF TEXAS
COUNTY OF TARRANT �
THIS CONTRACT AND AGREEMENT made and entered into as of the
day of , 1974, by and between the City of Fort Worth, a
municipal corporat ated in Tarrant County, Texas, acting by and through
it duly authorized City Manager and the Trinity River Authority of Texas, a
governmental agency of the State of Texas, acting by and through its duly
authorized Board of Directors, and the City of Hurst, a municipal corporation
acting through its duly authorized City Council , and the City of North Rich-
land Hills, a municipal corporation, acting through its duly authorized City
Council , hereinafter called "Purchasers,"
W I T N E S S E T H
WHEREAS, the parties hereto have entered into an agreement by contract
dated April 18, 1969 for -the provision of sanitary sewer service in the Walker-
Calloway Branches drainage area of Tarrant County Texas; and
WHEREAS, those parties deem it advisable to amend the said contract
in order to improve the provision of sanitary sewer service in the areas affec-
ted thereby,
KNOW ALL MEN BY THESE PRESENTS:
That the third paragraph of Section 3 (a) of Item III of the April 18,
1969 contract is hereby amended to read and provide as follows:
The next adjustment of the charge rate following the
initial adjustment as set out above shall be effec-
tive October 1 , 1973, and charge rate adjustments shall
be made each year thereafter in accordance with the
procedures developed by the City of Fort Worth as a
result of the rate consultant's study.
IN TESTIMONY WHEREOF, after proper action by the respective governing
bodies for the parties hereto, we have caused these presents to be executed in

Due to the difficulty oi:1projecting operating and,maintenance costs for a ,
priod of five years ahead during this period of rising costs and changing ,
standard for sew Age, treatment operations by regulatory agencies, the City staff
h'a: popmsod to-<' ts customer cities that they agree to executing a Letter of
Agreement whereby the charge rate would be adjusted annually. Each.year when
the Water Departm�rit budget is approved, the customer cities will be:advised of
t�Ze naxt'year's charge rate. It was considered that this procedure would be' to .
the , est''interest 'of both parties. At this date, , nine "Letters':of Agreement" '
have been reigned and `returned to the Water Department. Other cities have indi�`
cta' ed they will also sign the Letters of Agreement.
The staff"will review the accounts of those cities that wish to continue o�z
tie e;ye'ar rate 'adjustment basis, When cumulative payments to the City of-
F�r Worth do nat .meet the cumulative 'co%st of service, it will .be necessary to
acv�se tTios.e cities' of the, necessity of a rate adjustment.

It 'is recommended :that'.the City Manager be authorized to sign the I,etters.'of ,
Agreement with. those cities who agree to the annual adjustment of 'the:
