HomeMy WebLinkAboutContract 9911 Alp e SUPPLEMENT TO CITY SECRETARY CONTRACT NO. 6523 CITY SECRETARY MEACHAM FIELD LEASE AGREEMENT CNTRACT No.2—F-11 ,� WITH TARRANT COUNTY JUNIOR COLLEGE DISTRI STATE OF TEXAS § COUNTY OF TARRANT § WHEREAS, on May 4, 1970, the City of Fort Worth and the Tarrant County Junior College District made and entered into City Secretary Contract No. 6523, whereby the City of Fort Worth leased unto the said Tarrant County Junior College District 43,900 square feet of land at Meacham Field in Fort Worth, Texas, for use by the District as a site for an aeronautical technology facility, the primary term of said lease agreement being for a period of two years, with fourteen successive two-year options to renew; and WHEREAS, the City of Fort Worth and the Tarrant County Junior College District desire to supplement said City Secretary Contract No. 6523, by entering into an agreement whereby the City will lease unto the District an additional 6,624 square feet of land for use by the District as an aircraft parts storage yard, said supplemental agreement to remain in full force and effect so long as City Secretary No. 6523, remains in force and effect; NOW, THEREFORE, KNOW ALL MEN BY THESE PRESENTS : That the City of Fort Worth, a home-rule municipal corporation in Tarrant County, Texas, acting herein by and through Morris C. Matson, its duly authorized City Manager, hereinafter called "Lessor, " and the Tarrant County Junior College District, a tax-supported educational institution, acting herein by and through its duly authorized representative, hereinafter called "Lessee", do hereby make and enter into this Supplemental Agreement: OFFICIAL RECORD CITY SECRETARY FT. WORTH, TEX. 1. Lessor hereby leases unto Lessee two additional tracts or parcels of land embracing a total of 6,624 square feet of unimproved real property at Meacham Field, Fort Worth, Texas, lying adjacent and contiguous to the west side of the presently demised premises under City Secretary Contract No. 6523, said leased premises additionally demised being described more particularly as Lease Site "B" (containing 3,600 square feet) and Lease site "C" (con- taining 3,024 square feet) in the field notes marked Exhibits "X" and "Y" and outlined in blue and green respectively on the plat marked Exhibit "Z", said Exhibits being attached hereto and in- corporated herein for all purposes incident to this agreement. Lessee shall use the premises leased hereunder solely for the purpose of operating an aircraft parts storage yard. The term of this lease agreement covering the additional premises hereby demised shall begin on October 1, 1977, and shall remain in full force and effect so long as City Secretary Contract No. 6523 remains in force and effect. As annual ground rental for the additional premises leased here- under, as described in Exhibits "X", "Y" and "Z", attached hereto, said area containing a total of 6,624 square feet, Lessee shall pay to Lessor Eight (8) cents per square foot per year for an annual rental of Five Hundred Twenty-Nine and 22/100 Dollars ($529.22) so long as this supplemental agreement remains in force and effect. Such annual rental amount shall be payable in advance at the office of the Airport Manager at Meacham Field, on or before the 1st day of October of each year during the term of this agreement, beginning on the 1st day of October, 1977, and if not paid on or before said date, shall be deemed past due on the 10th day of October of each such year. -2- 2a The parties hereto covenant and agree that this lease agreement is a supplement to City Secretary Contract No. 6523. The terms and provisions of this supplemental lease agreement are expressly incorporated into said City Secretary Contract No. 6523, and are made a part thereof; and all provisions, covenants, recitals, terms and conditions to said City Secretary Contract No. 6523 shall apply to this supplemental lease agreement. The college's aeronautical technology facility containing offices, classrooms and hangar was con- structed on the site. Also located on the leased premises are aircraft and automobile parking areas. The primary term of the lease was two years beginning December 1, 1970, with fourteen successive two-year options to renew. The lessee has exercised its option each two years, the most recent remaining in effect until November 30, 1978. Ground rental rate is $.03 per square foot per year of $2,634 annually. In order to amortize the City's total cost in constructing the improvements, the lessee pays, in addition to the ground rental, $1,833.77 per month for the first 100 months of the contract. The lessee seeks to amend its lease to add an aircraft parts storage yard containing 6,624 square feet to the west of the hangar portion of the facility. Rental rate will be $.08 per square foot per year for $529.22 additional annual revenue. The amendment will become effective on October 1, 1977 and remain in effect so long as the lessee continues to exercise its biannual options. At its meeting on September 19, 1977, the Aviation Advisory Board recommended approval of the amendment to the lease. Recommendation It is recommended that the City Council authorize the City Manager to execute an amendment to the Tarrant County Junior College lease to add 6,624 square feet of unimproved ground space on Meacham Field under the terms and conditions set forth above. H. Duncan Survey, being part of a tract of land conveyed to the City of Fort Worth by deed recorded in Volume 1615, Page 292, Deed Records, Tarrant County, Texas, and also being a portion of Fort Worth Municipal Airport, Meacham Field, more particularly described using the Texas Coordinate System, North Central Zone, coordinates and bearings as follows: BEGINNING at the most westerly northwest corner of T.C.J.C. Lease Site A, said point being a corner of an existing building, said point bears East 986.0 feet and North 262.17 feet from the northeast corner of the P. Nicholas Survey, the coordinates of said beginning point are: x = 2,041,962.26 and y = 417,803,56; THENCE: North 3 degrees 11 minutes 44 seconds West with an existing chain link fence 144.0 feet to the corner of said fence, and the northwest corner of the lease being described; THENCE: North 86 degrees 48 minutes 16 seconds East 25.0 feet to the corner of an existing building and the most northerly northwest corner of said Lease Site A, being the northeast corner of this lease; THENCE: South 3 degrees 11 minutes 44 seconds East with the westerly line of said Lease Site A, and the westerly face of said building 144.0 feet to a corner of said Lease Site A, and the southeast corner of this lease; THENCE: South 86 degrees 48 minutes 16 seconds West with the face of said building and said Lease Site A, 25.0 feet to the place of beginning and con— taining 3,600.0 square feet of land more or less.
