JOINT RESOLUTION WHEREAS, the City of Fort Worth, a Home Rule Municipal Corpor- ation of Tarrant County" Texas, hereinafter called Fort Worth, and the Town of Lakeside, a City incorporated under the general laws of the State of Texas and located in Tarrant County, Texas, hereinafter called Lakeside, have corporate boundaries which are adjacent and contiguous; and WHEREAS, the City Council of Fort Worth finds and hereby declares that certain areas now within Fort Worth are more readily serviced by Lake~ / | side and that such will be to the benefit of all citizens; and WHEREAS, the City Council of Lakeside finds and hereby declares ' that certain areas now within Lakeside are more readily serviced by Fort ' Worth and that such will be to the benefit of all citizens; and ' WHEREAS, Fort Worth and Lakeside have determined and hereby declare that the mutual cmnnmn boundary line between the two cities should ` be and Is hereby determined, agreed and ratified; NOW THEREFORE, BE IT AES8LVE0 BY THE CITY COUNCIL OF THE CITY OF FORT NORTH AND THE CITY COUNCIL OF THE TOWN OF LAKESIDE: SECTION l THAT the mutual common boundary line between Fort Worth and ' Lakeside is hereby determined, fixed and ratified, and the same is hereby particularly described by metes and bounds as follows: BEGINNING at a point for corner in the Northeasterly line of pavement of the Southwesterly frontage road of Jacksboro Highway (State Highway No. } 199); said point for corner being sixty (GO) feet, more or less, at right / angles from the Southwesterly right of way line of Jacksburu Highway (State Highway No. 199), said point for corner also being in the North- Westerly right of way line, projected Northeasterly, of Young Road, also known as County Road No, 4023; THENCE Southwesterly along and with the Northwesterly right of way line of | Young Road (County Road Nn. 4023) produced Northeasterly and continuing ( along and with the Northwesterly right of way line of said County Road No. 4023 to a point for corner in the Fort Worth corporate boundary established by Ordinance No. 573 on May 16° 1916; said point for corner also being in the Lakeside corporate boundary; / ' ` THENCE in a generally Westerly direction along and with the Fort Worth Corporate Boundary established by Ordinance No. 513 and along and with the Lakeside Corporate Boundary to a point for corner, the northwest corner of the M. de LaGarza Survey, Abstract No. 616; in the east line of the J. Wilcox Survey, Abstract No. 1704; THENCE North along and with the Lakeside Corporate Boundary line and the east line of the J. Wilcox Survey, Abstract No. 1704 to a point for corner, the northeast corner of said Wilcox Survey; THENCE West, along and with the Lakeside Corporate Boundary Line and the ,north line of the J. Wilcox Survey, Abstract No. 1704 to a point for corner in the east right of way line of Silver Creek Road (County Road No. 4031). THENCE in a Northerly direction along and with the Easterly right of way line of Silver Creek Road (County Road No. 4031), and along and with said right of way line produced north, crossing State Highway F. M. 1886, to a point for corner in the north right of way line of F. M. Highway No. 1886, said point for corner also being in the Lakeside Corporate Boundary Line; THENCE East along and with the Lakeside Corporate Boundary Line and along and with the north right of way line of F. M. Highway No. 1886 to a point for corner in the west line of the M. Hunt Survey, Abstract No. 761; THENCE North 2640 feet to the northwest corner of the said Hunt Survey; THENCE East along and with the north line of the M. Hunt Survey to a point for corner at its intersection with the Northeasterly pavement line of the Southwesterly frontage road of Jacksboro Highway (State Highway No. 199) which point for corner stands sixty (60) feet more or less at right angles to the Southwesterly right of way line of Jacksboro Highway. THENCE Southeasterly along and with the Northeasterly pavement line of the Southwesterly frontage road of Jacksboro Highway (State Highway No. 199) to the place of beginning. SECTION 2 THAT Fort Worth and Lakeside Hereby agree to proceed with due'- diligence in adopting the necessary ordinances adjusting their respective corporate areas and all other proceedings necessary to effectuate this agreement; and SECTION 3 THAT Fort Worth and Lakeside mutually covenant and agree to protect, preserve and defend the mutually agreed common boundary against all parties whomsoever; and - 2 - SECTION 4 THAT Fort Worth does hereby relinquish to Lakeside all extra- territorial jurisdictional rights it may have within the area circumscribed by the above described mutual common boundary line. SECTION 5 THAT Lakeside does hereby relinquish to Fort Worth all extrater- ritorial jurisdictional rights it may have without the area circumscribed by the above described mutual common boundary line. SECTION 6 THAT this agreement shall become binding upon the City of Fort . Worth and the Town of Lakeside upon the adoption of this Joint Resolution in regular open City Council meetings of the City of Fort Worth and of the Town of Lakeside. SECTION 7 THAT this Joint Resolution, upon adoption by both cities shall be executed in duplicate originals and a copy thereof shall be spread in full on the minutes of each city. SECTION 8 THAT the above referenced and described mutual common boundary line between Fort Worth and Lakeside is shown on Exhibit "A", a map attached hereto and expressly incorporated herein by reference for the purpose of illustrating and depicting the hereinabove described mutual common boundary line. Partially developed property in Fort Worth (24 acres) including Vance Codbey's front yard, .a residence, a.drive-in, a church and an antique store; all on the west side of Jac sboro Highway, will be made available for annex4ition by Lakeside. On ,the west side, both Fort Worth and Lakeside will release territory so that the dividing line between the two cities will be Silver Creek Road. Nimes 81e Town of Lakeside and the City of Fort Worth have completed negotiations and have executed a Joint Resolution fixing and establishing mutual common boundary line between the two cities (M&C PZ-416, January 4, 1971) . Under the to of the Joint Resolution each city will discontinue certain area and make it available for annexation by the other city so that neither city will have territory in conflict with the mutual common boundary line agreement. When the Council adopted the Joint Resolution the staff was authorized and directed to prepare the necessary disannexation and annexation ordinance to effectuate the terms of the agreement. Lakeside is now in the process of discontinuing areas to be annexed by Fort Worth. It is time for Fort Worth to discontinue the areas to be annexed by Lakeside. Attached is a copy of map showing the area to be discontinued by Fort Worth. An ordinance will be submitted for Council action.
