ORDINANCE NO. '7"
AN ORDINANCE SPECIFYING THE ADJUSTED TOTAL NUMBER OF
AUTHORIZED CIVIL SERVICE POSITIONS AT EACH CLASSIFICATION
(RANK) IN THE FIRE DEPARTMENT FOR FISCAL YEAR 1993-1994;
PROVIDING FOR THE DELETION OF ONE (1) POSITION IN THE
DEPUTY CHIEF CLASSIFICATION; PROVIDING FOR THE ADDITION
OF ONE (1) POSITION IN THE BATTALION CHIEF
CLASSIFICATION; PROVIDING THAT THIS ORDINANCE SHALL BE
CUMULATIVE; PROVIDING A SEVERABILITY CLAUSE; AND
PROVIDING FOR AN EFFECTIVE DATE.
BE IT HEREBY KNOWN:
WHEREAS, the Fire Chief has requested the City Council to
readjust and thereafter specify the total authorized number of
civil service positions at each rank in the Fire Department for the
remainder of 1993-1994 Fiscal Year; and
WHEREAS, in previous ordinances, the City Council has
expressed the intent to reorganize certain duties within the Fire
Department, meaning that from time to time, and as normal attrition
from the Department occurred, certain civil service positions would
be deleted while at the same time the Department would maintain
efficient operations by redistributing those duties to other
personnel. This intent was expressed as being in the best interest
of the Fire Department and the City of Fart Worth in providing the
citizens of Fort Worth the most efficient fire protection possible
at the lowest expense necessary; and
WHEREAS, recently one vacancy at the rank of Deputy Chief has
occurred and said vacant position is now subject to deletion as
expressed in said previous ordinances; and

WHEREAS, the specification and authorization by ordinance of
the correct number of authorized civil service positions is a
statutory requirement; NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That, effective immediately upon passage of this ordinance,
the following positions are the only authorized civil service
positions for each classification (rank) in the City of Fort Worth
Fire Department for the remainder of the fiscal year of 1993-1994
or until a subsequent ordinance is enacted to modify said
authorized positions: '
Deputy Chiefs 4*
Battalion Chiefs 18**
Captains '7 0
Lieutenants 95
Engineers - J S
Firefighters ~~
TOTAL 652
*Deletes one Deputy Chief's position.
**Increase in one Battalion Chief's position.
SECTION 2.
The Deputy Chief position deleted by this ordinance was a
position which was subject to being filled pursuant to a promotion
from a civil service promotional eligibility list and was not
subject to being filled by discretionary appointment by the Chief
of the Fire Department. After the deletion of said position, the
remaining four (4) Deputy Chief's positions shall consist of three

(3) positions subject to being filled by discretionary appointment
and one (1) position subject to being filled from a civil service
promotional eligibility list, if and when subsequent vacancies
occur.
SECTION 3.
The "Mayor and Council Communication" memorandum which is
presented contemporaneously with this ordinance is hereby expressly
incorporated herein by reference for further clarification and
explanation of the purposes and intent of the Council in their
adoption of this ordinance.
SECTION. 4.
This ordinance shall be cumulative of all provisions of
previous ordinances and of the Code of the City of Fort Worth,
Texas (1986), as amended, except where the provisions of this civil
service staffing ordinance are in direct conflict with the provi-
sions of such ordinances and such Code, in which event conflicting
provisions of such ordinances and such Code are hereby repealed.
SECTION 5.
It is hereby declared to be the intention of the City Council
that the sections, paragraphs, sentences, clauses and phrases of
this ordinance are severable, and, if any phrase, clause, sentence,
paragraph or section of this ordinance shall be declared
unconstitutional by the valid judgment or decree of any court of
competent jurisdiction, such unconstitutionality shall not affect
any of the remaining phrases, clauses, sentences, paragraphs and
sections of this ordinance, since the same would have been enacted

by the City Council without the incorporation in this ordinance of
any such unconstitutional phrase, clause, sentence, paragraph or
section.
SECTION 6.
This ordinance shall take effect and be in full force and
effect from and after its passage, and it is so ordained.

CHIEF'S POSITION IN THE FIRE DEPARTMENT
RECOMMENDATION.
It is recommended that the City Council adopt the attached ordinance which will decrease the
total number of authorized Fire Department Deputy Chief positions from five (5) to four 14) and
also increase the total number of Battalion Chief's positions from seventeen (17) to eighteen
(18)
DISCUSSION
There is currently one Deputy Chief vacancy in the Fire Department There is no civil service
promotional eligibility list in effect for the position Deletion of the one Deputy Chief position will
change the current authorized strength as follows

Also, the Fire Chief has requested creating one (1) additional position at the classification of

FISCAL INFORMATION/CERTIFICATION.
The Fire Department anticipated these changes in its budget for the fiscal year 1993-1994,
therefore no additional costs or savings are realized by the deletion or addition
