HomeMy WebLinkAboutOrdinance 11201"' .f y ORDINANCE NO ~' AN ORDINANCE INCREASING APPROPRIATIONS IN THE SPECIALLY FUNDED CAPITAL PROJECTS FUND IN THE AMOUNT OF $67,239 00 FOR THE PURF~.;SE OF FUNDING ENGINEERING SERVICES RELATED TO THE CITY'S UNDERGROUND STORAGE TANK COMPLIANCE PROGRAM, PROVIDING FOR A SEVERABILITY CLAUSE, MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES AND REPEALING ALL PRIOR ORDINANCES IN CONFLICT HEREWITH, AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS SECTION 1 That in addition to those amounts allocated to the various City departments for the Fiscal Year 1992-93 and in the Budget of the City Manager, there shall also be increased appropriations in the Specially Funded Capital Projects Fund in the amount of $67,239 00 for the purpose of funding an amendment to the contract with Environmental Manager's, Inc. for engineering services related to the City's underground storage tank compliance program. SECTION 2. Should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3 That this ordinance shall be cumulative of Ordinance No 11151 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4 This ordinance shall take effect and be in full force and effect from and after the date of its passage, and it is so ordained. Authorize the City Manager to execute the attached amendment to City Secretary Contract No. 17498 with Environmental Manager's Inc., to continue engineering services and oversight of the City's underground storage tank (UST) remediation program, increasing the total Phase II project cost by $395,009.00 from $774,050.00 to $1,169,059 and the total contract not to exceed amount from $949,050.00 to $1,344,059. DISCUSSION: On September 19, 1989, the City Council approved M&C C-11879 which authorized a contract with Environmental Manager's Inc., for the development of the City's UST program. The project was divided into two parts. Phase I, development of a compliance plan, was completed in 1990. Phase II, engineering oversight on remediation projects identified in Phase I, is anticipated to be complete in 1995. The initial M&C fixed the contract cost of Phase I at $175,000.00 and included an additional $171,000.00 for Phase II. The Council was informed that the total cost for Phase II could only be determined as contract work progressed, but that work in addition to the $171,000.00 would require Council action to amend the contract and provide additional funds. The Council has previously approved contract amendments totalling $603,050.00. Planned UST projects during FY 1992-93 include removal of 39 UST'S, installation of 16 Above Ground Storage Tanks, and site assessments, groundwater monitoring and preparation of appropriate Remedial Action Plans. The additional $395,009.00 being added to EMI'S contract is required to pay the engineering costs associated with the FY 1992-93 UST projects. FISCAL INFORMATION/CERTIFICATION: The Director of Fiscal Services certifies that upon adoption of the attached appropriations ordinance, sufficient funds will be available in the current budget of the Environmental Management Fund . The remaining balance in the Specially Funded Capital Projects Fund for environmental projects will be $27,087.00.
