HomeMy WebLinkAboutOrdinance 11007,.~ P~ ORDINANCE N0. /©~ _ AN ORDINANCE VACATING, ABANDONING AND CLOSING AND EXTINGUISHING A UTILITY EASEMENT LOCATED WITHIN THE STONEGATE ADDITION TO THE CITY OF FORT WORTH, TEXAS; PROVIDING FOR REVERSION OF FEE IN SAID LAND; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That the five (5) foot wide by approximately eighty-five (85) foot long utility easement located between Lots 3 and 4, Block 13, Stonegate Addition, as recorded in Volume 388-196, Page 83, P.R.T.C.T., and as more specifically described in attached Exhibit "A", attached hereto and incorporated herein, be and the same is vacated, abandoned and permanently closed and extinguished. SECTION 2. That the fee to the land in the above described vacated utility easement is hereby released and shall revert to the adjacent owner as provided by law, SAVE AND EXCEPT that easements are retained for any and all existing and prospective utilities. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. That this ordinance shall take effect and be in full force and effect from and after the date of its passage, and it is so ordained. DISCUSSION: Ms. Susie Minter, purchaser of the properties, and acting on behalf of the property owners, has requested that the City Council adopt an ordinance vacating the above- described utility easement (as described on the attached map and field notes). The easement does not contain any utility facilities and is being vacated to facilitate the development of Lots 3 and 4. Reviewing City departments and private utility companies have raised no objections to this request. This request is located in Council DISTRICT 9. FISCAL INFORMATION/CERTIFICATION: A one dollar fee satisfies the interest of the City of Fort Worth in this request.
