HomeMy WebLinkAboutOrdinance 11009., .' ° r:~ ,: ORDINANCE NO. `~ U® AN ORDINANCE VACATING, ABANDONING AND CLOSING AND EXTINGUISHING A UTILITY EASEMENT LOCATED WITHIN THE GARDEN ACRES BAPTIST CHURCH ADDITION TO THE CITY OF FORT WORTH, TEXAS; PROVIDING FOR REVERSION OF FEE IN SAID LAND; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That the five (5) foot wide by approximately three hundred twenty (320) foot long utility easement located along the north ' property line of Lot 1, Block 1, Garden Acres Baptist church Addition, as recorded in Volume 3711, Page 311, P.R.T.C.T., and as more specifically described in attached Exhibit "A", attached hereto and incorporated herein, be and the same is~;vacated, abandoned and permanently closed and extinguished. SECTION 2. That the fee to the land in the above described vacated utility easement is hereby released and shall revert to the adjacent owner as provided by law, SAVE AND EXCEPT that easements are retained for any and all existing and prospective utilities. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. That this ordinance shall take effect and be in full force and effect from and after the date of its passage, and it is so ordained. This easement does not contain any utility facilities and is being vacated in order to facilitate development of the property. Reviewing public agencies and private utility companies have raised no objections to this request. This request is located in Council DISTRICT 9. FISCAL INFORMATION/CERTIFICATION: A one dollar fee satisfies the interest of the City of Fort Worth in this request.
