HomeMy WebLinkAboutOrdinance 11010r; ORDINANCE NO ~w AN ORDINANCE APPROPRIATING $200,362 TO THE WATER AND WASTEWATER OPERATING FUND AND DECREASING THE UNRESTRICTED, UNDESIGNATED RETAINED EARNINGS BY THE SAME AMOUNT FOR THE PURPOSE OF ACQUIRING THE LEASEHOLD IMPROVEMENTS ON FOUR LAKE WORTH LEASES, PROVIDING FOR A SEVERABILITY CLAUSE; MAHING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES AND REPEALING ALL PRIOR ORDINANCES IN CONFLICT HEREWITH, PROVIDING FOR ENGROSSMENT AND ENROLLMENT; AND PROVIDING A1V EFFECTIVE DATE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS SECTION 1 That in addition to those amounts allocated to the various City departments for the Fiscal Year 1991-92 and in the Budget of the City Manager, there shall also be increased appropriations in the Water and Wastewater Operating Fund in the amount of $200,362, thereby decreasing the unrestricted, undesignated Retained Earnings by the same amount for the purpose of acquiring the following leasehold improvements on Lake Worth. Lot 7R, Block 28, from B W Dixon Estate and Mary F Dixon for $51,076 00 Lot 10, Block 28, from Regan T Houston Estate and Mary E Houston for $46,286 00 Lot 4, Block 22, from J W Ashley and Bernice Ashley for $38,000 00 Lot 3, Block 28, from B E Ellis for $65,000 00 SECTION 2 Should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgement shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. ~, ~- 3µ SECTION 3 That this ordinance shall be cumulative of Ordinance No 10892 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed SECTION 4 The City Secretary of the City of Fort Worth is hereby directed to engross and enroll this ordinance by copying the caption and effective date into the minutes of the City Council and by filing this ordinance in the ordinance records of the City of Fort Worth SECTION 5 This ordinance shall take -effect and be in full force and effect from and after the date of its passage, and it is so ordained. Authorize the acquisition of leasehold improvements located on the following Lake Worth leases: A. Lot 7R, Block 28, from B. W. Dixon Estate and Mary F. Dixon for $51,076.00. B. Lot 10, Block 28, from Reagan T. Houston Estate and Mary E. Houston for $46,286.00. C. Lot 4, Block 22, from J. W. Ashley and Bernice Ashley for $38,000.00. D. Lot 3, Block 28, from 6. E. Ellis for $65,000, and 2. Adopt the attached supplemental appropriation ordinance increasing the Water and Wastewater appropriation by $200,362.00 and decreasing the Unrestricted, Undesignated, Retained Earnings of the Water and Wastewater Operating Fund by the same amount.. DISCUSSION: On March 4, 1981, M&C G-4890, the City Council approved the Lake Worth Land Use and Management Plan as prepared by Carter & Burgess, Inc. The leases in Phase II of this plan expired January 31, 1992. These leases are in that phase. This property was appraised by Paul Ondo, MAI. Checks will be made payable to designated title companies. This property is located in DISTRICT 7. FISCAL INFORMATION/CERTIFICATION: The Director of Fiscal Services certifies that upon adoption of the supplemental appropriation ordinance funds required for this expenditure will be available in the Water and Wastewater Operating Fund.
