ORDINANCE NO. ~~~~~
AN ORDINANCE AMENDING CHAPTER 3, "AIRPORTS AND
AIRCRAFT", OF THE CODE OF THE CITY OF FORT WORTH BY
CHANGING CERTAIN PROVISIONS CONCERNING THE AVIATION
ADVISORY BOARD; PROVIDING A SEVERABILITY CLAUSE; PRO-
VIDING FOR PUBLICATION IN PAMPHLET FORM; PROVIDING AN
EFFECTIVE DATE.
SE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That Section 3-20 of Chapter 3, "Airports and Aircraft", of
the Code of the City of Fort Worth is hereby amended to read as
follows:
"Sec. 3-20. Aviation Advisory Board - created; com-
position; appointment; compensation.
"The City Council shall appoint an aviation
advisory board, composed of nine (9) members who shall
serve in places numbered 1 through 9. No person shall
be eligible for appointment to membership on the board
who is not a citizen of the United States and a resident
of the City. The members of the Board shall serve
without compensation and shall be subject to all rules
and regulations which may be adopted by the City Council
regarding appointive boards and commissions of the City.
The Aviation Advisory Board shall act in an advisory
capacity to the City Manager and the City Council in
accordance with established City policy governing City
advisory boards."
SECTION 2.
That Section 3-24 of Chapter 3 of the Code of the City of
Fort Worth be amended to read as follows:
"Sec. 3-24. Same - powers; jurisdiction; scope of
activities.
"(a) The Aviation Advisory Board, subject to the
authority of City Council, shall have the authority to
review and recommend to the City Manager any and all
plans of any extensions, improvements and additions to
the airport system and master plans. In the same manner
such Board may also recommend the adoption of rules and
regulations for the government of the airport system.
"(b) The Board will review and comment on the
annual operating budget and capital improvement
requests. The Aviation Advisory Board will make recom-
mendation to the City Manager and City Council, consis-
tent with the Charter, concerning the leasing of lands
and granting of concessions or franchises for the privi-
lege of doing business in or on the properties of the
airports system in cases where such leases, concessions
or franchises might have an impact on the development of
the airport's system and its master plan. The Board may
review and recommend to the City Manager and the City
Council a schedule of rental rates and other fees and
charges for tenants. and other lessees of airport prop-
erty."
SECTION 3.
It is hereby declared to be the intention of the City Council
that the sections, paragraphs, sentences, clauses and phrases of
this ordinance are severable, and, if any phrase, clause, sen-
tence, paragraph or section of this ordinance shall be declared
unconstitutional by the valid judgment or decree of any court of
competent jurisdiction, such unconstitutionality shall not affect
any of the remaining phrases, clauses, sentences, paragraphs and
sections of this ordinance, since the same would have been enacted
by the City Council without the incorporation in this ordinance of
-any such unconstitutional phrase, clause, sentence, paragraph or
section.
SECTION 4.
The City Secretary of the City of Fort Worth, Texas, is
hereby authorized to publish this ordinance in pamphlet form for
general distribution among the public, and the operative provi-
sions of this ordinance as so published shall be admissible in

evidence in all courts without further proof than the production
thereof, as provided in Chapter XXV, Section 3, of the Charter of
the City of Fort Worth, Texas.

SECTION 5. 4
This ordinance shall be in full force and effect from and
after its passage and publication as required by law, and it is so
ordained.

SUBJECT ORDINANCE AMENDING CHAPTER 3 "AIRPORTS AND AIRCRAFT" OF THE CITY CODE
RECOMMENDATION:
It is recommended that the City Council appmove the adoption of an ordinance revising
Chapter 3 "Airports and Aircraft" of the code of the City of Fort Worth Texas.
DISCUSSION:
The last major update of Chapter 3 "Airports and Aircraft" was completed in 1991.
Since that time the City Council Committee on Citizen Advisory Boards and Commissions
has begun a review of individual boards. The Aviation Advisory Board was selected as
the first entity for analysis. The Council committee recommendations for revision of
the Aviation Advisory Board are contained in the attached ordinance. The attached
ordinance removes the language "through the Director of Aviation". This will permit
the Aviation Advisory Board to act in an advisory capacity to the City Manager and City
Council on matters identified in Sections 3-20 and 3-24.
The Aviation Advisory Board motioned "approved" with a vote of Yes-5 and No-0 at its
November 19, 1992, meeting.
