_. ORDINANCE NO. AN ORDINANCE VACATING, ABANDONING AND CLOSING AND EXTINGUISHING TWO UTILITY EASEMENTS LOCATED WITHIN THE FIELDS-WELCH ADDITION TO THE CITY OF FORT WORTH, TEXAS; PROVIDING FOR REVERSION OF FEE IN SAID LAND; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. THAT the five (5) foot wide by approximately ninety (90) foot long utility easement and the fifteen (15) foot wide by approxi- mately one hundred (100) foot long utility easement, as both are located on Lot 9-R-1, Block 3, Fields-Welch Addition, as recorded in Cabinet B, Slide 517, P.R.T.C.T., and as more specifically described in attached Exhibit "A", attached hereto and incorporated herein, be and the same are vacated. SECTION 2. That the fee to the land in the above described vacated utility easements is hereby released and shall revert to the adja- cent owner as provided by law, SAVE AND EXCEPT that easements are retained for any and all existing and prospective utilities. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. That this ordinance shall take effect and be in full force and effect from and after the date of its passage, and it is so ordained. Thence north 82 degrees-24 minutes-19 seconds east, along the centerline of said lateral #2508, a distance of 60-53/100 feet to the beginning of a curve to the left with a radius of 15 feet. DISCUSSION: Radiation Therapy and Chemotherapy Association, owner of all adjacent property, has requested that the City vacate these two utility easements (delineated on the attached map and further described in the attached field notes). The utility easements contain no utility facilities and a satisfactory replat delineating the vacation of these two utility easements has been submitted. Reviewing City Departments and private utility companies have raised no objections to this. This request is located in COUNCIL DISTRICT No. 9 FISCAL INFORMATION/CERTIFICATION: The Land Agent for the City of Fort Worth has determined that a $1.00 fee satisfies the interest of the City of Fort Worth in the vacation of these utility easements.
