AN ORDINANCE APPROPRIATING $52,809 00 TO THE SOLID WASTE
FUND AND DECREASING THE UNRESERVED, UNDESIGNATED
RETAINED EARNINGS OF THE SOLID WASTE FUND BY THE SAME
AMOUNT FOR THE PURPOSE OF PROVIDING MATCHING FUNDS FOR
A GRANT FROM THE TEXAS WATER COMMISSION, PROVIDING FOR
A SEVERABILITY CLAUSE, MAKING THIS ORDINANCE CUMULATIVE
OF PRIOR ORDINANCES AND REPEALING ALL PRIOR ORDINANCES
IN CONFLICT HEREWITH, AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL, OF THE CITY OF FORT
WORTH, TEXAS
SECTION 1
That in addition to those amounts allocated to the various City departments for the Fiscal Year 1992-93
and in the Budget of the City Manager, there shall also be increased appropriations in the Solid Waste
Fund in the amount of $52,809 00 ,thereby decreasing the unreserved, undesignated retained
earnings of the Solid Waste Fund by the same amount, for the purpose of providing matching funds for a
grant from the Texas Water Commission.
SECTION 2.
Should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for
any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair
the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions
shall be and remain in full force and effect.
SECTION 3
That this ordinance shall be cumulative of Ordinance No 11151 and all other ordinances and
appropriations amending the same except in those instances where the provisions of this ordinance are in
direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions
of said prior ordinances and appropriations are hereby expressly repealed.
SECTION 4
This ordinance shall take effect and be in full force and effect from and after the date of its passage, and it
is so ordained.

ADOPTION OF-SUPPLEMENTAL APPROPRIATIONS ORDINANCE-~FOR~THE~PURPOSE OFD` ~=:-

1. Authorize the City Manager to accept a grant from the~Texas Water Commissionz=for
Solid Waste Enforcement for the program year, December 1, 1992 through~November
30 , 1993 , i n an amount not to exceed $77 , 200.00 , and -- .~.,.~y~~~~~ ~~,
2. Adopt the attached supplemental appropriations ordinance increasing appropriations
by $52,809.00 in the Solid Waste Fund and decreasing the unreserved, undesignated
retained earnings of the Solid Waste Fund by the same amount, and

It is recommended that the City Council: °::~~-~~~~4;~:.-- _
3. Approve the transfer of $52,809.00 from the Solid Waste Fund to the Grants Fund,
and
4. Apply indirect costs in accordance with Administrative Regulation 3-15 (apply the
1992 rate of 25.93 percent which represents the most recently approved rate for
the Municipal Courts Department), and
5. Authorize the City Manager to set up a grant project in the Grants Fund contingent
upon contract execution with the Texas Water Commission.
DISCUSSION:
The Texas Water Commission is providing 50% matching grants to eligible local
governments for solid waste enforcement programs. The programs funded will provide
enhanced or new local enforcement capability against illegal dumping, littering,
improper transportation or shipment of solid wastes and improved ability to respond
quickly and effectively to solid waste related complaints.
The enforcement program must also increase citizen awareness of environmental, public
health and public nuisance problems commonly associated with the handling and disposal
of solid wastes.
The City Services Department has proposed combining the forces of the nuisance and
complaint resolution and the training of the Code Enforcement Division, the enforcement
of the Municipal Court's Marshal's Office, and the public education expertise of the
Solid Waste Clean City Program into one program for enhanced enforcement of solid waste
codes.

SUBJECT ACCEPTANCE OF TEXAS WATER COMMISSION SOLID WASTE ENFORCEMENT GRANT AND
ADOPTION OF SUPPLEMENTAL APPROPRIATIONS ORDINANCE FOR THE PURPOSE OF
PROVIDING MATCHING FUNDS
Taking a proactive approach, two deputy marshals trained both as peace officers and
solid waste nuisance abatement personnel can stop haulers prior to possible illegal
dumping and educate them about proper and legal disposal methods for their loads.
Surveillance of known dumpsites will also be performed with immediate arrests possible.
Education of merchants and businesses about contracting for hauling of disposable and
potentially recyclable items will also be performed. Educational material will include
information about proper and legal disposal methods, the required permits for hauling
and the recycling alternatives for some items Once developed, this information will
be available for distribution to haulers, businesses and the public at large.
The Texas Water Commission has offered to reimburse the City up to $77,200.00 for this
program provided the City also provides $77,257.00 as in-kind costs or a cash match for
positions, equipment purchases, supplies and other miscellaneous costs. Of the
$77,257.00, $24,448.00 will be in-kind salary costs of current supervisory and training
positions and $52,809.00 will be a cash match for equipment, training, supplies and
publications costs for this program. If at the end of the year's program any of the
cash match remains, it is to be transferred back to the Solid Waste fund balance.
The objective of this program of stepped-up enforcement and education is to deter and
reduce illegal dumping in this city and to provide for a quicker response to the
abatement of illegal dumping.
FISCAL INFORMATION/CERTIFICATION:
The Director of Fiscal Services certifies that upon adoption of the attached
appropriations ordinance and approval and completion of recommendation 3, funds will
be available for the City match for this grant in the operating budget of the Grants
Fund.
The unreserved, undesignated retained earnings (preliminary, unaudited) of the Solid
Waste Fund will be $1,402,719 00 after this supplemental appropriation action.
