AN ORDINANCE VACATING, ABANDONING AND CLOSING AND
EXTINGUISHING A UTILITY EASEMENT LOCATED WITHIN
THE BAILEY'S INDUSTRIAL ADDITION TO THE CITY OF
FORT WORTH, TEXAS; PROVIDING FOR REVERSION OF FEE
IN SAID LAND; REPEALING ALL ORDINANCES IN CONFLICT
HEREWITH; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT
WORTH, TEXAS:
SECTION 1.
THAT the eight (8) foot wide by two hundred five (205) foot
long utility easement located equally between Lots 5 and 6, and
Lots 7 and 8, Block 15, Bailey's Industrial Addition, as recorded
in Volume 388-C, Page 5, Tarrant County Deed Records, and more
specifically described in attached Exhibit "A", attached hereto
and incorporated herein, be and the same is vacated, abandoned
and permanently closed and extinguished.
SECTION 2.
That the fee to the land in the above described vacated
utility easement is hereby released and shall revert to the
adjacent owner as provided by law, SAVE AND EXCEPT that easements
are retained for any and all existing and prospective utilities.
SECTION 3.
That all ordinances or parts of ordinances in conflict
herewith are hereby repealed.

SECTION 4.
That this ordinance shall take effect and be in full force
and effect from and after the date of its passage, and it is so
ordained.

SUBJECT VACATION OF A UTILITY EASEMENT: BAILEY'S INDUSTRIAL ADDITION, BLOCK 15, LOTS
5 - 8 CULLEN STREET AT VACEK STREET V-91-39
RECOMMENDATION:
It is recommended that the City Council adopt the attached ordinance vacating an 8-feet
wide by 205-feet long utility easement located equally between Lots 5 & 6 and 7 & 8,
Block 15, Bailey's Industrial Addition.
DISCUSSION:
Sprint Press, Inc., owner of all adjacent property, has requested that the City vacate
this utility easement. It is being vacated in order to construct a dock area over the
existing easement between two existing structures on the properties. The easement
contains sewer, electric, and telephone utility facilities. The City's Water
Department has agreed to abandon the sewer line subject to construction of a manhole
at the end of the utility easement at Vacek Street; Texas Electric Utilities has agreed
to the vacation of the utility easement, and Southwestern Bell Telephone has agreed to
the vacation subject to the retention of an aerial easement 18 feet above the ground
level. A satisfactory plat has been submitted providing for this aerial easement.
Other reviewing City departments and private utility companies have raised no
objections to this request.
The subject property is located in Council DISTRICT 7.
FISCAL INFORMATION/CERTIFICATION:
A one dollar fee satisfies the interest of the City of Fort Worth in this request.
