ORDINANCE N0. ~~~
AN ORDINANCE VACATING, ABANDONING AND CLOSING AND
EXTINGUISHING A PORTION OF A DRAINAGE EASEMENT
LOCATED WITHIN THE CHAPEL CREEK RANCH ADDITION TO
THE CITY OF FORT WORTH, TEXAS; PROVIDING FOR
REVERSION OF FEE IN SAID LAND; REPEALING ALL
ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN
EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT
WORTH, TEXAS:
SECTION 1.
THAT the one (1) foot wide by approximately thirty-two (32)
foot long portion of a drainage easement located in Lot 8,
Block 1, Chapel Creek Ranch, as recorded in Volume 388-206,
Pages 99 and 100, P.R.T.C.T., and as more specifically described
in attached Exhibit "A", attached hereto and incorporated herein,
be and the same is vacated, abandoned and permanently closed and
extinguished.
SECTION 2.
That the fee to the land in the above described vacated
portion of a drainage easement is hereby released and shall
revert to the adjacent owner as provided by law, SAVE AND EXCEPT
that easements are retained for any and all existing and
prospective utilities.
SECTION 3.
That all ordinances or parts of ordinances in conflict
herewith are hereby repealed.

That this ordinance shall take effect and be in full force
and effect from and after the date of its passage, and it is so
ordained.

PROPOSED DRAINAGE EASEMENT VARIANCE
A field note description of a proposed drainage easement variance or revision
in Lot 8, Block 1 of Chapel Creek Ranch, Phase IA, an addition to the City
of Fort Worth, as shown on the plat thereof, recorded in Volume 388-206
at Pages 99 and 100 of the Plat Records, Tarrant County, Texas,. and located
at 10600 Bing Drive of said city, said variance being more particularly
described by metes and bounds as follows
BEGINNING at a point on the North right-of-way of Bing Drive in the south
boundary of Lot 8, Block 1, being in a curve to the right whose center bears
North 18 degrees 49 minutes 54 seconds East 1,545 00 feet for the south
end of the existing 10 0 foot drainage easement and being 10 00 feet westerly
on said curve from the southeast corner of said Lot 8, Block 1,
THENCE, North 18 degrees 27 minutes 39 seconds East on the west boundary
of the existing 10 foot drainage easement, 32.00 feet to a bend,
THENCE, South 71 degrees 32 minutes 21 seconds East, perpendicular to the
existing west boundary, 1.00 feet to a bend,
THENCE, North 21 degrees 28 minutes 25 seconds East, 38.05 feet to a point
fora bend,
THENCE, North 71 degrees 32 minutes 21 seconds West, 3.00 feet to a point
in the existing west boundary of said 10 foot drainage easement for a bend,
THENCE, North 18 degrees 27 minutes 39 seconds East, on said existing west
boundary of said easement, 60 00 feet to the existing north end in the north
boundary of said Lot 8, Block 1, being a curve to the left whose center
bears North 18 degrees 51 minutes 57 seconds East, 1,415 00 feet and the
northeast corner of Lot 8 bears around said curve 10.00 feet.

SUBJECT VACATION OF A DRAINAGE EASEMENT: CHAPEL CREEK RANCH, BLOCK 1, LOT 8 (BING
DRIVE EAST OF DEAUVILLE DRIVE V-91-55
RECOMMENDATION:
It is recommended that the City Council adopt the attached ordinance vacating a 1-foot
wide by approximately 32-feet long portion of a drainage easement located in Lot 8,
Block 1, Chapel Creek Ranch.
DISCUSSION:
Choice Homes, Inc., owner of the subject property, has requested that the City Council
vacate the above-described portion of a drainage easement. The vacation is necessary
in order to complete construction of a residence that is presently under construction
within that portion of the drainage easement proposed to be vacated. The encroachment
is the result of an error in surveying the location of the residence on the property.
Reviewing City departments and private utility companies have raised no objection to
this request.
The subject vacation is located in Council DISTRICT 3
FISCAL INFORMATION/CERTIFICATION:
A one dollar fee satisfies the interest of the City of Fort Worth in this request.
